Can you travel to visit while i-130 is pending? URGENT

Hello everyone! My husband and I have an i-130 petition pending. we have been waiting for 4 months and 1 day so far, anyway, my husband got sick anb he's been hospitalized and he's in ICU. I'm so worried about him and wish I could be there for him, my question is if I could travel while our 1-130 is pending, I don't wanna do anything that will compromise our petition or even make it harder for us, its just its frustating and I just wanna know if it's an option. Thank you!

If you can have a visa tourist then no problem. You need to be honest at POE about your pending I-130 but your entry is not guaranteed.

yes you can travel while the i 130 is pending but first you should check on what citizens from your country require to enter USA. If you need to get a tourist visa then you need to do that first. Bring all your papers (noa1/form I-797, marriage certificate, etc) showing you are awaiting approval to immigrate and proof of ties to your home country to prove you will return (mortgage, rental agreement, employment letters, bills, etc).

be honest at customs and immigration, have all documents ready should they ask and be sure you have a copy return details in hand (booking confirmation or trip documentation)...... they might want proof of your return trip.

I do have a tourist visa. We met and got married in the states but I'm waiting abroad. the problem is that I'm not currently working, renting anywhere neither going to school. I'm living with my family, we are waiting for this process to be done to start a new life in the states(there's no point for me to do any of those things If I'll be leaving). We are a young couple. I'm 21 and he's 23 but we love each other so much it's crazy. I only have the medical records that he's sick and recently put in ICU. I just want to be there with him during this time. I mean is that enough for them to let me in?

Oh well heck you already have what you need the Tourist Visa and the proof why you need to come an emergency. And this will not in any way compromise or interfere at all with your application.

So get on a pane and get to your husband. I pray he is well soon. I am sure a visit from you will make him better fast. All the best.

my hubby planned of me going to usa as tourist while case is already filed but someone said it will conflict my petition, so we didnt push with the plan, but for you i suggest ask ur spouse to show a doctors'certification for him to show to nvc and see if its okay for you to travel and see him/her the only way is make a formal written request, are u the one goin to the states?

If you have an immigrant visa pending, then it is a violation of your tourist visa to travel using the tourist visa because a condition of this visa is you have no intention of moving to the U.S. however, the decision is ultimately by the immigration officer at your point of entry. They can choose to admit you or choose to deny you entry and you will not know until you arrive. Traveling is a risk because if they accuse you of violating your visa then it can cause loads of problems with your I-130. That is a risk you need to decide if you are willing to take. Also, it is not possible to expedite your I-130 for medical reasons.
