RFE June filer - Birth certificate?

He should call and ask them exactly what's the problem.

I wouldn't send the original.

We sent a copy of the front only and biographic page from the passport. Had no problem. So I would make sure if they want something else or sending a copy will be fine. ( they ask for copies always because won't return the originals so a copy is not the problem )

i realize that that would be the best option.

I just want to know why this wouldn't be good enough...

It is an offical birth certificate..

I would rather not spend 300 dollars on a pasport and have this be enough..

If there could be any case that he forgot and others have send this too and got approved i would rather do that

1. A passport does not cost $300.

2. Even if the passport were to cost $300, you will be in a world of pain because the AOS fee is $1,070

3. In an emergency a passport will come in handy.

Okay here is the problem.. We sent a copy of the birth certificate ( long version ) see picture. That's the one we made a copy of.

And i also attached my RFE letter.. My fiance says he 'thinks' he put the copy he in there. With this RFE we just dont know for sure.

Can anyone please look and see if this is a valid version? It has the offical stamp on it? why could this not be good?

My only thought could be that its a copy and therefore not good?

If so i'm just going to send this one the original one. I cant see a reason as to why i should apply for another one and send that one, if we have this version.

He doesn't have a pasport yet. We where plannig on getting one after i moved there so we could travel to see my family.

Has anyone seen this before?

If the usc does not have a pass how did he traveled to visit u? u know that one of the req of K1 visa is that ur fiance visited ur country (u) at least once on the past 2 years. Good luck and dont send the original, send a copy again, if u didnt sent a cover letter for ur petition they probably lost that copy verifying all papers

Good luck and dont send the original, send a copy again, if u didnt sent a cover letter for ur petition they probably lost that copy verifying all papers

Exactly. They need to prove that they have met in person in the last 2 years. It doesn't matter where. As far as I remember she mentioned that they lived together for 9 months.

Thanks, and Yes we have lived together for 9 months in the us.

I checked with the post office an expedited pasport is 230 dollars.

We already have money set apart for aos ticket and marriage and everything else. That's not the issue. It's more that we rather not expedite it. And spend more money if we don't have too. Since we have a valid birth certificate.

His mom said she can get another original certificate from the town hall I think.

So is she sending is that. And we are gonna send the one he has now. And apply for a "regular" pasport in the meantime.

Please call first and ask them what was wrong with this one. You don't want to go back and forth and delay the process. I have a feeling they are asking for another proof of his citizenship. Since he doesn't have a passport they may think that the bc itself is not sufficient.

it's so weird though in the RFE letter it clearly states

a birth certificate OR a passport.

You are playing with fire. An RFE, although it can mean your application is "touched" and close to approval, is negative if not properly responded to. Some petitioners have had their case closed because they claimed they were "right" and resent basically the same info requested, as opposed to doubling down and strengthening their response with more than is asked in the RFE. If you sent the birth certificate and received such a response, you better believe your "citizenship" is being questioned, whether right or wrong, thus the addition of a passport would be extremely helpful. Sometimes they just want to see a passport to cover their bases. They have the power. Tread carefully.

If you just go down to the post office the one that processes passports and has an office and present the birth certificate they will check off that identification and you will raise your hand and take the oath and not have to send it in. Pay the fee and they will put in the envelope and zip zip send off. That's how i did when I came back from Nigeria after marriage and needed to change my passport to new married name. Saves time and you wont need to order new nothing and you have original.

Personally I think their issue is the certificate is to plain for them. You know most are colored and this one is just white.

Also I think it had to do (maybe) with the issue date. I think maybe the one adjudicating you petition didn't understand that 2002 date on there (she/he might think he's 12. LOL) I know not funny but well it is USCIS. Why not do like others say first call USCIS request to talk to a Tier 2 Supervisor and just see if you can get some clarity than act accordingly.

Even when I don't understand the USCIS mind, I think what you are saying to some extent is true. I got a RFE for BC, a lawyer advised me to send the same copy that I had sent. My instincts wouldn't let me do that, knowing that a RFE is one golden chance and you don't play with it. I was given 87 days to respond so it could not be just an easy task. Nway I had the civil authority issue another BC and make a copy that was certified by the same authority before I sent it. I realized that they had a mistake at the office with my BC in a way that if one tried to search for it in the system, it was unavailable. Good luck, this process may be spendy however you rather do things right rather than regret. You might be fine too sending the same copy but sending an original copy is pointless, if they wanted an original copy they will specify that.

Anyway. We called the USCIS. And they basically said "do as stated on the RFE"

He then asked. Should o send the birth certificate. Or is it better to send more evidence.

They replied the more the better.

So he is going to call the post office and making an appointment for an expedite passport. And we will send a copy of that too.

And also another question.

I was expecting to get an RFE for the pictures we forgot to send. Even though we have more then evidence of meeting since we lived together.

Should we just put the pictures in the RFE with the pasport copy? Or just forget about the pictures. Since they didn't ask for it?

send them what was asked for in the RFE. If pictures weren't asked for, don't send them.
