I have Form I-864 dated 3/22/2013 and Instructions dated 3/22/2013.

Instructions say:

Part 6. Annual Household Income

This section is used to determine the sponsor's household income. Take your annual individual income from Item Number 5 and enter it on Item Number 6.c. If this amount is greater than 125 percent (or 100 percent if you are on active duty in the U.S. military and sponsoring your spouse or child) of the Federal Poverty Guidelines for your household size from Part 5., Item Number

8. , you do not need to include any household member's income.

= = = = = = =

This seems to be misworded. Item Number 6.c is the current income for Person 1, if income from a Person 1 who is a member of household is being counted.

It seems the Instructions should say: Take your annual individual income from Item Number 5 and add to it any numbers listed in 6.c, 7.c, 8.c. and 9.c. and enter it on Item Number 10.

= = = = = = =

Did anyone note this potential error; and how did you handle it ?

Leo

Hi All!

I'm so glad to have found this forum!

My husband and I also filed in November. Here is our timeline:

11/03: Receipt of I-765

11/05: Receipt of I-485 and I-130

11/26: Suspended review of I-485 and sent RFE

12/10: Lawyer notified us of RFE (we never got a hard copy of RFE in mail)

01/07: Mailed further evidence package

01/09: Receipt of further evidence package. Review of I-485 resumed

01/16: EAD card was ordered.

I strongly suggest everyone to get on the USCIS website and monitor your case, even if you hired a lawyer. There were some personnel shifts in the law firm we hired right around the time the RFE was sent and we didn't find out until two weeks later. Due to timing and incredibly back luck, we weren't able to send a response until over a month after the RFE.

Our primary concern was the EAD because I have been out of college for over a year now and haven't been able to work! So I am glad that my EAD card was ordered already! Does anybody know how long it takes for it to be delivered?

Hi Oeni, have you received the below status update after receipt of RFE?

On January 28, 2015, we received your response to our Request for Evidence for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSCxxxxxxx. Our National Benefits Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. You should receive a decision or case update by March 29, 2015, unless fingerprinting or an interview are needed.

AOS Filing progress:

Package Filed: Dec 16

USCIS Receipt Update: Dec 18

Bio Appointment : Jan 16

RFE Receipt: Jan 23

RFE USCIS Receipt: Jan 28

EAD Approved: Feb 23

Hi! Yes, that's been our status since they received our response to the RFE. Ours says March 10, though. I think USCIS really strives to complete the entire process within a 4 month period.

In a case like that do this :

go to www.google.com

type:

form I-nnn question nn "forum"

or

form I-nnn question nn site :visajourney.com

It is faster to google than to post and wait for a reply :)

I have Form I-864 dated 3/22/2013 and Instructions dated 3/22/2013.

vvvlll, thanks for your reply.

The answer to my question will only come from those like you who have recently filed the I-864. Can you just please look at the I-864 you recently filed and the instructions as they apply to my question . . . and tell me what you did.

Thanks a lot,

Leo

I can't speak to the accuracy of the instructions but we didn't enter anything for 6-9 of part 6 as we were not counting income from anyone else in the household. The form itself (864) is very clear that q.5 pertains to the sponsor's income and 6-9 apply to any other members of the household if applicable.

Well, I just had a job interview and was offered a great corporate job, a short distance away from home that has a great salary, benefits and lots of local plus international travel - only problem is, my AP and EAD haven't been approved yet. My fear is that it might be delayed due to the initial AOS packet being returned because a page was missing, resulting in a delay in our application. Have got an info pass interview set up for 11 Feb (earliest I can get) yet prospective employers want to. The joys of immigration.

Fingers crossed that things move faster!
