k1 denied can I get a waiver for my I 130

Hey I had an interview in August got denied because they thought we were related and I was helping him out which is total bullshit they said they were sending my papers uscis which I found out its not true its still in my country i want to get married in Jan. And start a cr1 visa can I get a waiver or try to apply for one thanks i went to an immigration officer and told me yeah but at this point I dont believe uscis anymore thanks

Timeline

Send in a letter withdrawing your I-129F petition. Mail one to the USCIS service center that approved your petition, and to the consulate. After you receive confirmation of your petition withdrawal, go ahead and file the I-130 after you marry.

I see no mention of a need for a waiver.

Just curious how will getting married fix the "they think we are related" issue?

And petitions sit for months many cases until they come around to the embassies and pick up. It's usually 6 months to 8 months to get back to USCIS.

They just assumed I was helping him they never gave me a chance to show them proof that we not related about the paperwork why would it say returned to nvc when in fact its still in the office im hear waiting to contact nvc and nothing its ridiculous seriously

They just assumed I was helping him they never gave me a chance to show them proof that we not related about the paperwork why would it say returned to nvc when in fact its still in the office im hear waiting to contact nvc and nothing its ridiculous seriously

Wouldn't getting married and filing for cr-1 just bring this issue up again? Did you ask why they thought that you were related?

We had our K1 denied in April, In June of this year we got married, Our K1 petition was sent back to the states, I didn't cancel that petition at all, but just when a head and filed the CR-1 in August, about 3 weeks after i filed the CR-1, I received a letter in the mail stating that the K1 had expired, and no further action would be taken. There is no wavier needed, once you get married it will cancel out the K1 anyways.

I wonder if you can provide DNA samples to prove that you are not blood relations if that is what they believe.

wow ok did you receive a noa 1 yet on the cr-1 i want to add more proof this time and some proof showing that we aren't related i think we were targets you know young couple doing a k1 visa this really sucks but i think this visa is way better they get here in the states with a green card and ss and cheaper too i think because k1 you have to spend 1070 for the green card and all that stuffs as cr-1 its 88 plus 230 for nvc and 420 for the petition but i can get that waived my immigration officer told me which is good can you let me know if anything changes in your petition just in case thanks

Yes we received our noa1 on August 18. And we're sent to Nebraska service center. Which seems to be the slowest! We added a lot more proof to this one. And letters from family and friends
