I make above the 125% poverty for the affidavit, however, I don´t own a home or have any assets. Do I need to have anything or will my income be sufficient? I have a daughter and am petitioning for him and his daughter, so there are four of us, and I make $51,500. This will be my second year with the school, and my previous district (which is on my W2) paid more than my current district, so I have a dependable income, but will that be enough without anything else?

Asset only comes into play to boost your qualification when your income is not sufficient.

Looks like you have plenty of room.

I would still send in my bank statements as proof of the savings I have in the bank, and depending on who looks at the form they might send an RFE. In theory however, since I make enough money with my salary I could, again in theory, send my pay check stubs, my W2, and the letter from my employer about my employment status as evidence of my income. The bank statements are to support the income. I plan on including everything because everyone has their own interpretation, and you´re better off sending everything. They want to see year round what your savings-checkings has looked like and make sure you´re stable.

If you make enough income to meet the requirement, then no assets need to be listed. You can leave that entire section blank. Bank statements would not be needed if not using assets. Just the most recent tax transcript, letter from employer and/or most recent pay stubs should be all you need.

If you want to list assets and send bank statements, then you can, but they are not a requirement if you earn enough to meet the guidelines for your household size plus the intending immigrants.

How do you compute for the 125 % income?

My fiance still lives with her mom together with her brother, sis in law and niece.

Are you asking how is it calculated? it doesn't matter if the petitioner lives with her family, what matters is her income covers the poverty line for the household size she supports. Are her Mom, brother, sister in law, and niece considered her dependants? Does she list them as dependents on her federal tax return?

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

06-03-2022: Interview scheduled (online notice).

06-10-2022: Interview letter received via USPS.

Nope she doesn't have any dependents. We don't know if her income is enough already for the 125% poverty line.

Nope she doesn't have any dependents. We don't know if her income is enough already for the 125% poverty line.

Then her household size is 2 = herself, and the beneficiary. She needs $19,662. Please look at the poverty guidelines.
