What paperwork should I file now that my fiance is here?

Hello everyone,

Finally, my fiance is here. We started last year in July and she finally just got here this month. I am really confused right now on what we should be doing. She has been here two weeks. Should I file for a Social Security card now? What other forms should we be filling out. We are planning on doing the wedding with about 15 days left, is that enough time? Please please please help. All of the info seems to be about getting your fiance here, but afterwards, I don't know what to do now (legally that is lol). Forms or other threads would really be helpful. We want to get everything rolling so she can find a job and get a drivers license.

You can apply for a Social Security card, but after you get married if your fiance wants to change her name she is going to reapply with new name. we waited till after we got married to apply for her social security card.

21 Aug 2013: I-129F Sent

11 Feb 2014: Visa APPROVED!

20 May 2014: Wedding!

31 Jul 2014: Mailed AOS Packet

12 Feb 2015: AOS Interview - Approved

22 Feb 2017: Mailed ROC Packet

Hi there,

You can't do much of anything until you guys get married. As mentioned above, your fiance could get a SS card but would have to re-apply once their name was changed (assuming it's a female). You could start preparing your paperwork and saving money for filing fees so that you have things ready when the time comes, but you cannot legally submit the applications associated with K1-based Adjustment of Status until you have your marriage license.

If you go to "Form Downloads" at the top of the VisaJourney website and then click on "Adjustment of Status (Green Card) Forms" everything should be there! I used this checklist and cross-checked it with what USCIS.gov said I should have and things went well; nothing was missing. It is helpful to look at the "Instruction Sheets" for each form number on USCIS.gov.

You will need I-485 - Application to Registered Permanent Residence or Adjust Status

I-864 - Affidavit of Support (be sure to include the sponsor's tax returns, two most recent pay stubs, as well as employment verification with this form)

G-325A - Biographical Information (one for both you and your fiance)

I-765 - Application for Employment Authorization (this application, once approved, will get you a card that allows you to work while waiting for your Green Card)

I-131 - Application for Travel Document (usually approved alongside the Employment Authorization and combined into one card, this will allow you to travel outside of the United States while waiting for your green card)

G-1145 - E-Notification of Application/Petition Acceptance (this is optional if you want to receive emails/text messages regarding the status of your pending cases.)

But, like I said, the forms themselves are available under the link I mentioned above.

Be sure to submit evidence of your relationship with your fiance along with the applications (joint lease, photos, emails, etc.), they seem to hold these in high regard.

You have 90 days to get married. As long as you are within the time frame, you should be fine.

As of right now, she can't apply for social security because you guys are not married yet.

So here are the steps you have to take:

1. Get married

2. Bring passport, I-94, birth certificate, original marriage license to SS office

3. Apply for AOS (read the guides on forms and requested documents) this allows her to get EAD combo card which enables her to work and travel.

Seems like HM has spelled it out nicely for you on his/her post.

However the OP's fiancè has not adjusted status yet.

K1 visa holders can get a SSN before marriage. Bringing your marriage licence to the Social Security Office only serves as a purposes of showing your new married name. Being married has nothing to do with your eligibility of receiving a SSN.

When applying for SSN before marriage, a K1 visa holder can visit their SS office with their passport and I-94.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

Also note that you have to apply for the social security card a specific time before the I-94 expires. I believe it's 2-3 weeks. (My husband received his social security card two weeks after he arrived, and about two weeks before we got married. The I-94 is what gives you the permission, as the K-1 is no longer valid the minute you pass through the POE–at least, as I understood it.)
