I M Booking our flights.

These are the options. Does anyone know which to choose?

Im thinking non us resident as we have not been admitted yet at POE.

  • If you are a US passport holder, click on a circle in US Passport Holder column.
  • If you are a permanent landed US resident (Alien Registration or Permanent Resident Card holder), click on a circle in Landed US Resident column.
  • If you are not a US resident, click on a circle in Non-US Resident column.

Does anyone know?

If you will be entering the US using a visa and you are not a resident and do not have a green card, then yes, you are a non-US resident.

Since you're not a U.S. resident yet, as you already mentioned, you'll have to enter

as a visitor, so, the third option would apply.

BE CAREFUL HERE

You now have an application for a (permanent) visa running, and the officer at the

POE will see that. Although in many cases there does not seem to be a problem

with this, they CAN deny you entry with a visitor's visa if you have another application

pending. They could think you might (over)stay regardless. We all know this would be

a very silly thing to do, as it'd endanger your pending application, but still.. they CAN

assume that, and deny you entry.

If you DO take that flight, make sure you have with you a copy of the NOA2 (or at least

the NOA1), and plenty of paperwork proof that you're supposed to return by a certain

date (rental agreement, signed letter from your employer, etc) in case you need to

convince the POE officer you "really will have to return!"...

Have a safe trip!

Im so sorry I didnt explain myself properly. I had my interview and received my immigrant visa. Even though I am a legal permanent resident now, I havent gone through POE yet so do not have my actual green card. Just not quite sure which option to choose, thanks again

You are still a non-resident until you actually arrive in the USA.

If you are trying to book a one way flight, be careful, the website may not let you. That's what happened to us, they actually let us book and then 30 mins later I got an email saying the flights were cancelled as I was not a US citizen or greencard holder and thus not allowed to book a one way flight! Had to call themand sort it out. Of course, usually return flights are cheaper anyways.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am confused. You have had your interview, and you received your visa. OK, that is good.

If this is a K-1 visa, you are now allowed to travel into the U.S., and that 'trip' has the sole purpose

of getting married to your loved one. After that, you can request AOS/EAD/AP and you'll be fine.

But... this is just a "travel authorization" ! You are NOT a legal permanent resident yet.

When you travel into the U.S., and go through the POE, your K-1 visa will be "activated" by the

POE officer, and, from that moment on:

- your K-1 visa is no longer valid (it has been "used")

- your status as a visitor is legal, for up to 90 days

- you have to get married within those 90 days, or leave before that time is up

So... even if you travel into the U.S. on a tourist visa or visa waiver, the POE officer will see on

their screen that you have an approved K-1, and will "use" that. As far as I know, you cannot

"keep" the K-1 for later, and just enter the U.S. as a visitor ... and then at a later date return

again, and use the K-1. Sorry...

its ok ive done it. Im IR1 visa not K1 . i put down permanent resident, thanks so much for your help :)

But you're not a permanent resident until the immigration officer at the port of entry authorizes your entry on the visa.....hope this works for you and doesn't cause problems. (If it's just for the airline, I don't think it's a huge issue what you mark, to be honest).

Congrats on getting the visa and safe travels!

You are NOT a permanent resident. You will be once you enter the US, but not one second before. You need to change the booking to show non-permanent resident.

Actually Fred, the CBP likely has no idea the a person has a visa process running unless you're a) sent to secondary and they look it up or b) you tell them. The USCIS doesn't just openly share that information back and forth.

Once you have the visa, the CBP still don't know until you say something.
