Yeah, I thought it had just said IE as well. Glad they're finally up on the times though. Only took them a few decades :lol:

Hi All,

Canadian Citizen, married to American Citizen living in Toronto for the past 7 years (married 7 years). Leaving Canada for the U.S.

Just submitted the I-130 (along with the G-325a for the both of us) and item was delivered successfully today :)

Will be visiting my in-laws for a few days in June. Will this cause any issues for me crossing the border?

Also, anyone what the approximate wait time is from end to end in terms of submitting the app I-130 to getting the Greed Card for Canadian Citizens?

I need some help.

I've attached the page from my interview letter under "Required Visa Interview Documents"

I understand it all until I get down to the last three:

F - Petitioner Marriage Certificate

F - Petitioner Birth Certificate

11 - Petitioner Marriage Termination

The Document Status Code is "F" which means "NVC did not request this document" just as it did for the n/a items "Adoption", "Marriage Termination" "Court Records" all of which do not apply to him.

I just need to know if I need to send him the Petitioner Documents? Can someone help?

Ok so many of you have helped me with this tax 1040 filing single or married.

I have called my tax lady and i tried speaking nice with her and then she got an attitude. Ughh i lost it on her and I shouldnt have. Well she does my mothers taxes and she called my mom. She told my mom there is no way to file me married unless i have a federal tax number for my husband. Did anyone else have a federal tax number for their spouse? She said to get one my husband should go to the consulate with our marriage certificate and ask for one. Honeslty i dont believe or trust what she is saying. Help please can anyone confirm or deny any of this info.

She also said since my parents claimed me for the year that if i filed an admendment they would also need to file an admentment. I just want to cry, why didnt she tell us any of this when we filed!! She knew our situation

Hello and welcome!

This thread is not the correct place to be writing these types of questions. This thread is specific to NVC filers, the step after USCIS.

Crossing the border should be fine, bring evidences you'll be going back to Canada (lease, bank statements, letter from work, etc).

Wait time has fluctuated greatly within the past year. I think now the entire time is down to about a year.

Any tax preparer that uses a standard tax preparation software program is probably going to try this switcheroo. The standard programs will NOT let you file "Married" - either jointly or separately - without an ITIN or SSN in the line for the foreign national. And the tax preparer does not want to have to fill out the return manually.

I've seen this happen many times since I've been on VJ - and I wish there was something we could add about this to all folks who are going through the IR-1/CR-1 process.

It really is that the tax preparer is clueless or lazy. If you are married, and you know your spouse does NOT have an ITIN or a SSN, do NOT let your tax preparer file your return electronically. I do not know every tax return software program out there, but I know MY tax guy, who works for one of the Global Big 4 Accounting firms, taught me about this. Even his company's software program does not allow for a "married" return to be filed electronically without an ITIN or SSN for both spouses.

It is also a wake-up call for all people. We are all ultimately responsible for all the details and numbers on our tax returns. Even if you don't understand taxes at all (and who could understand US taxes!!!!!?????) look over your return every year before you give the OK to submit. Make sure your personal details are correct!

If you can file an amended return before your send in your AOS packet, you should not have a delay. Just don't let your tax preparer charge you for preparing the amendment!

I figured your tax preparer would say something like that. Just like Sukie said, whatever their reason may be (clueless, lazy), tax preparers mostly use their online filing software and most of these programs require that you put a SSN or ITIN for your spouse. In these situations, it is recommended to file taxes manually and submit via snail mail and just type "NRA" (non-resident alien) for your husband's SSN. At this point, just do the amendment and send it via mail to the IRS. If you are not comfortable doing it yourself and you do not want to deal with this person anymore, take all your tax docs to another preparer and explain your situation and what you need them to do. Again, do not let them tell you it cannot be done.

Not sure about being claimed in your parents' taxes and how it would affect everything. Unfortunately, I'm not too familiar with that aspect and I would hate to give you bad advice. Other members might chime in on that. However, you should be able to get everything done in the next few days and it should not delay your process.
