No NOA2 yet at Texas Center

Hi everyone!

I am the beneficiary and was wondering if I can call the service center and if they will give me information about the status of our petition (I-129F.. K1 Visa)? It's been over 3 months now since NOA1, and I read all over this website that some people have received RFE by mail without the website being updated. My fiance is out of town for a couple months and his cousins are taking care of his mail... I ask them once in awhile if they've received anything, but don't want to keep nagging. If we do receive a RFE, how long do we have to reply to it?

3 months is not that long. Maybe they won't ask for an RFE. However, It doesn't hurt to call so ask your fiancé to call the the service center. You can call too and just ask for an update. They will tell you about the current process time and ask you to wait but it is always a good thing to check. You can if you want.

Your fiancé should get an email as well once the NOA2 gets in the system.

I know how it is, I used to check twice a day. I was always waiting for the RFE like you but then I didn't got one and I got my approval , just be patience and be strong!

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You can call if you want to but I am afraid it won't do any good. Chances are the person you will be talking to will only have a terminal in from of them and will only be able to tell you the current status which you already know. You petition is probably sitting in a pile of petitions on someone's desk waiting to be processed. Like others have said 3 months is not very long. It may seem like a very long time to you, but in the big picture it isn't very long. Patience...

Hi there!

waiting up to 6 months for an NOA2 from Texas Service center is fairly average these days. I am a January filer and I've been waiting 4 months for my NOA2.

I made the following table https://docs.google.com/spreadsheets/d/1bdkZgfg-0CeJeCcapb9VLk-sr5FG2LWewyZbd5CSUgk/edit?usp=sharing to show just how many petitions Texas has right now in comparison to California which is approving petitions in under 60 days.

The most recent USCIS data depicts TSC consistently having twice the amount of petitions backlogged compared to CSC. TSC completes less petitions than CSC but yet TSC receives more petitions than CSC. Data taken direct from the USCIS website http://dashboard.uscis.gov/index.cfm?formtype=6&office=5&charttype=1

My fiance is in the military and he won't have access to his mail for a couple of months because he is deployed. He'll be back soon. Thanks for all the help! I am the beneficiary, our PD is November 18/2013 - I called USCIS on Friday as we are at 6 months and one week since NOA1. A very pleasant and friendly officer just read the same processing times off the website as I can see myself. He apologized profusely, but told me he could only speak to the petitioner or a legal representative. When I told him we had actually hired a lawyer, he told me that she could go online with a special form and access immediate and up to date status, and also put in a Service Request.

I contacted our lawyer and she is doing that tomorrow. (it was too late in the day Friday by the time I was able to contact her, 3 hour time difference)

I'll update again when I hear back from my lawyer and what she is able to find out. I have to hope we should see our approval within the next week or so, especially since we are well over the 6 month processing times.

Good luck to all.

PS I just realized tomorrow is a holiday in the US, so I guess I won't know anything more till later next week!! Grr Argh!! :(

I had my husband call and they told him that nothing was wrong and we would hear something in 22 days. He was right and we finally got approved after 210 days.

If you do ever get an RFE, you usually get about 89 or 90 days to respond to it, which is plenty of time.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I called them last week and I'm sure they told me the same thing they'd tell you - because it's the same thing they told somebody else here more than a month ago! They said they're currently working on November 16th petitions. So for more than a month they've been stuck on that day - apparently. At least that's what they say. At three months they'll definitely not tell you anything more than you can get from their website.

They've posted the current processing time for K-1s at Five Months. But even if you're over 5 months as I am, they'll tell you you're not over the posted five-month deadline!! So I wouldn't waste your time right now calling them. You're not supposed to call them anyway until you've over their posted time which is 5 months. But apparently in government-speak 5 months means anything longer than 5 months!
