I129F Possible Mistake Awaiting Possible RFE!!!!!!!!!

I read an old post here from 2006, it stated somebody got an RFE for not sending in the entire contents of their divorce papers. I have been married two times in the past one for 17 years one for 10 years. I included the page the judge signed on both divorces, it stated the judge and date of divorce. I thought it would be enough. I got my NOA1 on 2/25/14 should I have received an RFE by now if it was a problem? This is at the California processing center. My brother is petitioning for his Filipina fiancé, and from sending in his I129F till NOA2 took only 6 weeks total. Im thinking if they are on those timelines right now I should have received a RFE by now. Should I just right now send in all my divorce papers without receiving an RFE? or would that possibly confuse things? Thanks for all the help........

The chances approach zero that your mailing would meet up with your file. Wait to see what happens.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Why would you need to send divorce papers from the first marriage? It is obvious you divorced in order to marry a second time...

Have you heard of a situation where this was required?

I sent only proof of divorce for my second marriage so now I'm concerned.

actualy i read about a person here who did get an rfe for not submitting divorce papers from the 1st marriage, even though its obvious they couldnt have gotten married again

I understood all one needs is proof you are free to marry, so I'd hope the latest divorce decree would prove that.

I hope, but the US government can come up with some ridiculous rules to make immigration more difficult.

Most then likely you will get an RFE, you won't know until they actually get to your file and start processing it... until be prepared and have copies the complete divorce decree for each ready.

Do not sent the divorce decrees until USCIS sends the RFE.

Divorce information is required in regard to all previous marriages.

Most then likely you will get an RFE, you won't know until they actually get to your file and start processing it... until be prepared and have copies the complete divorce decree for each ready.

Do not sent the divorce decrees until USCIS sends the RFE.

Divorce information is required in regard to all previous marriages.

My fiance was married tow times and he only send divorce certificate of the second one, we didnt get rfe fot that.

That does not mean someone else would not. It is stated in the I-129F instructions to send in all of them >

7. If Filing for Your Fiancé(e) (K-1), What Documents Do you Need to Prove That Your Fiancé(e) Is Eligible for

K-1 Classification and That You Both Can Legally Marry?

a. If either of you was married before, submit evidence that all prior marriages have been terminated. Evidence of

termination of prior marriages may include a divorce decree, or an annulment or a death certificate issued by a

competent civil authority.

I just got an RFE two nights ago. I was so surprised because I sent in alot of information. I read that if you were married before you need to send a copy of a divorce decree which I didnt. I sent in a summary paper of my divorce proceedings but I have a strong feeling that they need more evidence that I am divorce from my previous wedding. When I get the RFE in the mail I will finally know. I am sure its that but we will see...

If you send in divorce papers do you also still have to send in a letter stating you are single and elegible to marry? I read for Cuba this document is required but if someone sends in the divorce papers would this other document still need to be sent in as well?

I would think even if you send divorce papers for the second you would also need to send the first in as well.. some people tend to get married when they are still married to the first husband/wife.

NOA2 - 8-18-15

Interview 11-25-15 - Denied

And Here we go again -

New K1 submitted - 1-9-16

NOA1 - 1-12-16 (according to USCIS)

Text received 1-15-16

hardcopy - not received yet as of 1-26-16

once they had your paperwork, how long till you got the RFE? and it should be more clear on the actual contents needed. All it says is "proof" which is what the page dated and stampedand signed by the judge proves. Why they would need every page of the divorce is ridiculous.

What I ended up doing was getting a copy of the legal record from the respective states. Fortunately, the states where I have lived have this service available. A simple Google search will likely yield some good hits. YMMV. For example, here is the one for Oregon: https://public.health.oregon.gov/BirthDeathCertificates/GetVitalRecords/Pages/index.aspx It costs a couple of bucks, usually one page. I got a couple of extra copies, since there is often a discount for additional copies obtained at the same time.

To the one poster that didn't get an RFE at the K-1 process, you dodged that one. Maybe you will get lucky again??? ;) At the AOS interview, I was asked by the IO to produce, for inspection, ALL of my divorce decrees. Thankfully, I was prepared and could easily provide them, as opposed to having a probable AOS approval delay and likely RFE for not having ALL of them. YMMV.
