Are you *sure* the previous visa was a K1? Do you have any paperwork related to it still? How long did the process in 2012 take? What paperwork/ documents (such as birth cert etc) did you submit?

As others have ,mentioned, it seems unlikely to get all the way to interview with a K1 without knowing what was applied for.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

This is about a K-1 fiancee visa

I had a friend apply for a k1 visa for me. She was just very good friend. But now I find someone I wish to marry. Can they also apply for k1 visa? And if they do, will it cause any problems in getting visa?

so can we apply K-1 with diffrent diffrent persons?

You were committing visa fraud since your "very good friend" signed a letter of intent to marry you with no intent to do so. This is why the rest of us have to go through nonsense. Thanks.

A simple answer is "yes", any US Citizen can petition for K1 visa infinite number of times,

but just realize that a right to submit petition is completely different from getting the visa approved.

But by playing with (illegal) fire the first time, you are now spewing very visible smoke

and someone will notice it, and I think both you and the original petitioner likely have

seriously lowered your chances at getting future K1 visas approved.

Just realize that its people like you that try to cheat their way into US

is what is causing so much scrutiny and delay in processing time to legitimate couples.

I have my doubts, but hopefully you are cleaning up and this new petition is real.

A US citizen can only receive TWO approved fiancee pettions in a lifetime and within a two year period only ONE, unless they are granted a waiver. While waivers are often granted if the reason is sufficient, to say that petitions are "unlimited" or infinite is wrong.

It seems in this case the OP was commiting fraud with the first petition (there are no "very good friend" visas). I presume the 2nd ine is with another US citizen. If one petition has been withdrawn another can be filed.

High chances the second visa/petition will be in jeopardy since during the first interview no documents were presented and that should have gone on record. Many here are suspicious, so don't expect the CO to be any lenient. The whole good-friend-visa thing is very sketchy. You will have a hard time explaining this. On top of that, since same sex relations are not that common in India, that can add to the issues. Many hetero-sexual inter-racial, inter-religious couples are having trouble getting K-1 visas from Indian consulates, so your case is a tough sell given the circumstances. You will have to prove hard the legitimacy of the relationship.

This is not true. A USC is limited to two k-1 applications. After that a waiver would be required.

We are currently in relationship for 5 months. I have not known him previously. And I agree it does seem suspicious. We have just started discussing the permanence of our relationship and the options....................................................................it seems I may have not told complete truth.sad.png I will post again when I understand better.

It seems you don't really know either the K1 visa process. Do you realize you can be approved as fast as 2 months from filing at embassy and he at interview within 5 months?

Do you realize you HAVE to be married within 90 days of him coming to the US? 5 month relationship and you two are ready to marry? (Not doubting I am asking because it seems like a visit is more in order.

Also i have to ask the most important question. Have you two meet face to face yet? You can't file until you meet (unless you are approved to have the meet waived)

My Lover who is in India, started this forum. He is concerned that his english is to bad to write here. We are a gay couple. I am in USA, and I was concerned when he mentioned that a straight friend of his had applied for a k1 visa a few years ago. He says he was unaware that the visa she applied for was a fiance/marriage visa until he went to interview. He went to interview with no paperwork. The visa was denied. This is it in a nutshell. He was only trying to visit USA. I know these kinds of actions, no matter what, do harm to those who are legit. I to was concerned about "visa fishing" when I first met him. And if not for my elderly parents, he would wish I come live with him in India. He is better off than I am. I told him I was very concerned about this and would like some opinions. And I do appreciate ALL replies as all are constructive. Thx

Lots of red flags, the first denial with a straight person and now a same sex K-1 will raise a lot of questions for which an explanation will be asked IMO, and I think there isn't a good way to explain all that without bringing up the truth -which he should-, that is, that it was a fraudulent petition; which could trigger a denial and other actions.

I'd say that you need to consult a lawyer and see what your options are and what steps to take if you want to have a chance of successfully obtaining a visa for your partner.

You dont go to an interview without know that is for a fiance visa, the first thing you need to start the process is a letter of intent to marry, without the letter of intent the patition isnt approved.

After that when he went to tge consulate he cant go without know what was the interview for.

That isnt truth he knew very well that was a fiance visa.

Another thing the first petition was a woman and now a man?

That is red flag in india.

There is something not clicking here, I never knew anyone "Not knowing" what visa he/she is applying to, especially with the requirements for a K-1 that have several that clearly indicates to anyone that you are getting married (unless you absolutely speak 0 words in English, and if even if so, there is the question of signing something you do't understand)....

Secondary, the beneficiary receives a packet that describes exams and paperwork requirements; and he still shows up with none? Something is not right here.

As others have said, I'd make sure I'm getting the entire straight story before proceeding. As well, consult an attorney and the only way this attorney can help is by knowing the entire true story, otherwise you are just wasting your time and money.

Have you met in person? This is a requirement for the K1 , along with having to marry within 90 days of entering the USA.

2nd post...just wanted to separate the answers clearly...

There is something not clicking here, I never knew anyone "Not knowing" what visa he/she is applying to, especially with the requirements for a K-1 that have several that clearly indicates to anyone that you are getting married (unless you absolutely speak 0 words in English, and if even if so, there is the question of signing something you do't understand)....

Secondary, the beneficiary receives a packet that describes exams and paperwork requirements; and he still shows up with none? Something is not right here.

Good point you have mentioned the medical exam, before go to interview the consulate send to the beneficiary the instructions for medical exam, and you know very well that is for fiance visa, you dont know about type of visa at the interview , you know before go

Not only are you visible and red-flagged due to the first admitted fraud but if caught for the prior attempt (and there is no action of limitations on fraud--meaning that you can be charged and found guilty of fraud many years in the future) you can be deported and/or face prison time. I for one support very harsh measures on those who immigrate to America using fraudulent intent.

There is so much fraud that occurs in America I expect conditions will get tougher and tougher.

Are you sure you want to come to America with your admitted belief that you don't need to follow the law? This is not an American way of thinking.

Keep in mind that USCIS could, if they want to--subpoena information on you from VJ and find out who you are simply by the recorded IP (Internet address). 99% of the time such a query identifies the person. I for one wish that USCIS would get off their butt and clamp down on the real frauds.

People here are nice here, but you are a self-admitted criminal. Think about that.

Im sorry, but I just dont find he "i didnt know it was a fiancee visa until I got to the interview" story to be realistic. My Chinese fiancee's English is not as good as your boy 's, but she still had to not only write and sign a letter of intent to marry me within 90 days of entry, but she also had to write up a statement telling how we met and how our relationship progressed through to falling in love and getting engaged. Se had to sign these and snail mail them back so I could send them in with her original signatures.

She's proving she is single by getting documantation of this status too..

A lot of us here who are sufferring through long separations from our loved one and the "indignity" of jumping through so many hoops to prove we are legitamate couples (because so many others have tried to game the system can certainly be excused for finding ourselves feeling a bit offended by this hard to swallow tail.

Its of courese wholly possible that this time its the real deal. But I do hope as the US citizen, you are being cautious here and know what your getting into. If I were the consulate officer, Id find it hard to believe the story. Its like admission to prior purgery, or trying to claim complete ignorance to get out of having to admit it. Either way you will have a tough road ahead of you so I hope for your sake that you have some great documentation...

If I end up denied or waiting through long RFE's to be able be with my fiancee, or my mother, who has very bad metasticized lung cancer cant be at our wedding due to the delays, its these kinds of stories that are going to make it that much harder for me to stay calm and not flip out.
