I am confused now. Does the petitioner mail the I-864 and supporting documents or are you supposed to scan the documents and add it to the I-864 and send by email. Thanks in advance.

If you have opted for Electronic Processing (available for Canada cases), then you scan and email the I-864 and supporting documents.

Can you explain why the father wouldn't fill out an I-864a (rather than the I-864) if he is a household member with the petitioner?

If the petitioner is not claimed as a dependent of the father, then he is not viewed as a household member in this regard.

Unless you need to combine income then the joint sponsor should sign a completed I-864. If the father was claiming the petitioner as a dependent on his taxes he could then do an I-864a so they can combine their incomes. But it's easier to not do this because you have to prove a relationship and same address with you do the I-864a. If the petitioner doesn't make any money it doesn't make any sense to combine incomes. Also if the petitioner is not claimed as a dependent on the father's taxes then the father then as Ryan stated, he his not viewed as a household member even if they live in the same house.

Because the beneficiary is in Canada (or another EP eligible country) if you OPTIN for the electronic processing then the AOS documents must be sent via pdf in an email. If you did not OPTIN (and were accepted) for electronic processing then the documents must be mailed in to the NVC. You have to everything one way or the other. Doing both severely slows down your case file becaue they're not looking in the mail room for your documents if you've opted in for EP and vice versa if you have not. Do not send the documents via email until the OPTIN is accepted which can take about 2 weeks.

The instructions for the I-864a don't say anything about me needing to be a dependent, can you show me where it says that?? Basically I already filled out the I-864 and my parents both did an I-864a (since they file taxes jointly). I do make money but not enough to sponsor my husband, and I do live with my parents but they don't claim me as a dependent on their taxes anymore. I do have proof of relationship and all that already. Basically I want to know if I'm going to get a checklist if I send it as is.

Yes you probably will get a checklist. You are combining income with your parents so you all would need to make the income for you, your beneficiary(ies), both of your parents plus any dependents or children they have. You will certainly need to send proof of the relationship between everyone (a copy your long form birth certificate with both their names on it and probably a copy of everyone's driver's license to show the same address.)

If your parents make the amount to sponsor themselves and your spouse it's better to do

parent who makes most money = I-864

parent who makes less money = I-864a

Yes, you can send the AOS and IV packages together. It definitely won't speed up any processing though. Since the IV package can only be sent after the IV bill is paid (which only happens after the acceptance of the DS-261), you'll actually be holding onto the AOS package for weeks. Personally, I suggest, once you can, send the AOS package. Don't wait to send them together as you'll be waiting a couple of weeks, in which you could have sent the AOS package and have that package reviewed (and if you happen to get an AOS checklist, you'd actually save time than if you had waited to send it with the IV package).

Hi, was just approved last night. PD 3/22/13, transfer to TSC 11/15/13. Anybody know about how long it's been taking texas to transfer cases to NVC after noa2?

My husband and I got approved on Dec 31 at TSC and we still have not been transferred to NVC yet. We called once and they said it has been taking four to six weeks, but that I should call them every week just to check.

I am confused about the PCC. Some people seem to take it to the interview while others send it in to NVC. How does it work?

Ok, I'm a little confused as to what I should do now. My husband I filed our I-130 and then after seeing how long the waiting times were we filed the I-129F about 6 months in. Both were approved by USCIS and then I got a notice that the I-129F was "unapproved" and back in "initial review"...I called to inquire and USCIS tier 2 said "i have no idea what they are doing, sorry". So I left it at that. Proceed to wait for the I-130 to reach NVC.

I have confirmed many times that my case has been received by NVC, just waiting on case number. Today, I get a letter in the mail that NVC has received my I-129F and has forwarded it to the embassy in Mumbai!!! #######?? And that he can go head and apply for the K-3 visa.

Now I have no idea what I should do? Will I still eventually get the case number for the I-130 for the IR-1/CR-1? I know the K-3 is more expensive in the long run, but not by a ton if my calculations are correct in totaling the costs for both paths completely. I know he won't be able to work right away if he comes on K-3. Is he more likely to get approved for the K-3 or the IR-1/Cr-1 at interview?

What happens if we just ignore the letter from NVC regarding the I-129F and just focus on the I-130? I'm sooooo confused now!

Our petition was approved by TSC on Dec. 12 and just this january 6 we received a notification that it was shipped to NVC. Until now we have no case number yet. We will call this monday to inquire.
