My family was sponsored by my uncle for F-4 visa, and our file is complete. We are just waiting for our priority date (PD) to become current.

The problem is that we aren't sure how long its gonna take, and the same uncle's son (yes, my cousin tongue.png) is going to get married to my sister. Since no one's sure how long its gonna take us to immigrate there, it is being planned that he'll come to India, get married and file for a IR1/CR1 visa for my sister. There's nothing in our file mentioning about the planned engagement/marriage, as back then it wasn't planned.

The question here is - What effect will it have on the whole visa process for my sister and my family? Will there be any hinderence or complications in filing of the IR1/CR1 visa for my sister or our family's completed F-4 visa file (which ofcourse includes my sister as well)? What are your suggestions?

Your sister can get married if she really wants to and her USC husband can certainly file i130 for her.

Once she gets married, she automatically disqualifies herself as a derivative of the F4 petition but it will not affect you and your parents.

How old is the sister? If she is legally an adult, she can't get a visa on the uncle's family petition anyways. Her getting married and the cousin filing for her spousal visa should not have any negative effect.

Thanks a lot for answering smile.png , but the age limit is 21 years of age and that too wont disqualify me or my sister for the visa because of CSPA; which states that our age is frozen to when our file is completed, and during that time neither me nor my sister crossed the age of 21.

As for the complications or negatrive affect matter - there wont be any, right?

hi

that's not why your sister would be disqualified, the reason is marriage. to be a derivative of your parents, you have to be unmarried until you arrive in the US. if she marries, she won't be able to get her GC under her parent's petition, but now her husband would have to file for her

no complications for you, she just cannot get her GC that way, it has nothing to do with you. a person can have more than one petition filed for him or her at the same time.

it's her decision

CSPA freezes your age when the Priority Date becomes current. That will be 11 years from now.

CSPA does not freeze your age "when your file is complete."
