I did not have any income for the 2012 tax year (ZERO income). I'm not required to file taxes based on I'm under the minimum required income. I'm also not planning on filing for the sake of the I-864 so I need a written explanation of why I was not required to file taxes.

I was wondering if anyone had an example, or could provide the IRS link to the requirements I could use in my written explanation. I'm just a little confused on how I should word it, and if I should print something out from the IRS website showing it.

Keep it short and sweet. My husband wrote something like:

To whom it may concern,

I am Penguin_ie's husband and petitioning sponsor. During my three years in Ireland I did not work; I used savings and was maintained by my wife on her salary. Thus, I had no income or significant holdings in the USA was not required to file US tax returns with the Internal Revenue Services.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you very much..I assume not getting anything from IRS.gov was okay..just a simple letter/statement would do.

It would carry more weight if you could go to the IRS website and include the "WHO IS REQUIRED TO FILE A TAX RETURN" checklist and show that you do not fall under any category. There is the interest, dividend and capital gains, self-employment, and earned income questions that I know of. Typically if you just state that you had o earned income that will suffice as to why you were not required to file a tax return.

I wrote in my cover letter, when submitting I-864, that I was not required to file in 2012 because my taxable income

was not enough to require a filed return. In addition, I entered on line 13a 1 (total income for year 2012) "no/file/req".

The general rule for filing threshold is that your income must be below the total amount of your (standard deduction plus personal exemption amount). Then you are not required to file. Example, for single filer in 2012 the standard deduction was $5950 and the exemption was $3800 so not required to file if income below $9,750. For Married filing jointly this amount would be doubled to $19500.

But there are exceptions for self-employed so be careful !

Yes..these are all good responses. i was a little unsure what I should put into the I-864 form for the year. NO FILE, N/A or what. I didn't work or draw unemployment last year and I have no savings or investments. After splitting with the ex she took everything...she dried up the investments before 2012 though so no I didn't earn any interest or anything.
