Hi to everyone.

Ive been reading this forum for a couple of months now and I can say that I have learned a lot of things regarding cr1/ir1 visa. But I still have some questions on my mind left unanswered.

We just got married last April of this year. My husband is a Filipino but already a US Citizen. Before he came here in the Philippines for his vacation and our wedding, he was already unemployed for I guess six months because of lay off So when he went to back to US he asked his previous company if he can go back to work but sad to say the company is still having a crisis. He started looking for jobs everywhere and struggled finding a good one like his previous company who offered a good hourly rate. After a couple of months he accepted a job from a different company but it only pays $13 per hour. His previous job pays $39 per hour. Since he badly needs a job for he accepted it even if it pays low.

Anyway, he was unemployed for I think 8 months before finding a new one. I want to ask if he can file for cr1/ir1 visa for me cause its only been a month since he has a new job. We want to be with each other soon. I cant wait to be with him cause I miss him badly. I know maybe he cant fulfil the 125% poverty line but his mom and dad are earning good and is willing to help us for the joint sponsorship.

Need your help pls. Thanks

But his mom said that he should be employed at least one year on his new company to be able to file for the I-130F

I think his mum is erring on the side of caution. There's no length of time requirement for the job he holds.

Google for the i-864 instruction PDF and check the evidence requirements (tax returns, basically).

Also, by the time the bit comes where he presents the 864, he'll have held the job for quite a few more months.

So my husband can file it by next month?

Will it not be a hindrance for the timeline of the petition? Cause if we don't encounter any problem, I am hoping that the whole process be approve by 7 to 8 months

OK, how about this. Worst case, you don't think his job is gonna work. What do you do then? Do you have someone who'd joint sponsor? Because that would be fine.

As far as I know, that would only be the problem I have in mind.

Yes if his job doesn't work he has his parents to help us for the joint sponsorship

Then I'd get on and file and get the ball rolling. You won't have to submit the 864 until after i130 approval, so you can make a call then as to whether your husband is earning enough or whether to go with a joint sponsor. :)

His mom is incorrect and there is no such form as an I-130F; it's simply I-130.

As I know, he just needs a co-sponsor and a joint sponsor to support to bring u there, even if he doesnt have a job.

He will not need a joint sponsor if he works full time at a $13/hr job. Yes he would need those things if he was jobless.

how did u compute it? because he said that he needs $30k per year to.meet the 125% poverty line

What will your household size be? You, your husband... And anyone else? Kids?

hi,

how did he get that amount? there is a poverty guideline, the i864P and it is on the uscis website. it depends on the household size.

if it is only the 2 of you, he'd have to make only over 19k a year. how big is your family, do you have children?
