The child will automaticly be US citizen as long as the child was born in US (regardless the parents are US citizen or not).

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

Hello all, my wife and I are not US Citizens.

I want to know if my wife come over to the US to give birth will my child get the citizenship ?

If you both are not US citizen then your wife came here to give birth , the baby is automatic be a US citizen.

some country border's of the USA, they just came here to USA just to give birth .. just to get the US citizen of their child.

of course the expenses of tax payer!!! after they give birth now its responsible of the US government!!!

Timeline for my Mother

April 19, 2013 - submit the form I-130

April 22, 2013 - Receive the NOA1

July 29, 2013 - Approved NOA2 ( 82 working days)

July 30, 2013 - USCIS shipped my documents to NVC

Aug 5, 2013 - Arrived at NVC Building

Aug 13, 2013 - Got the NVC case # via PHONE

Aug 14, 2013 - Got the Invoice # via PHONE

Aug 15, 2013 - Send my DS-3032 via Email

Aug 16, 2013 - AOS Pay

Aug 17, 2013 - Got an email to print the COVER SHEET

Aug 21, 2013 - send the AOS overnight at NVC

Aug 28, 2013 - Accept the DS-3032

Aug 30, 2013 - IV BILL pay and Documents Sent to NVC receive the checklist AOS.

September 19, 2013 Sent back the checklist

September 20, 2013 Sept 26, arrived @ NVC

Sept 30,2013 - already encode to their system

Are you both going on holiday or something? On a tourist visa?

Your wife will likely not be allowed to fly in her final trimester (most airlines will not take the risk), so I wouldn't go planning any trips abroad if she's entering into that final phase.

Well, then, yes, if you have the baby while you are there then the baby will be a US citizen. That does not bestow any new rights to you or your wife, however, and you will still be there under the status you came under (i.e. if there as a tourist, you must still leave at the end of your allowed stay, stamped in your passport).

Your child won't really feel the benefits of US citizenship until they are older.

The child, if born on US soil is a US citizen. This will confer absolutely no immigration rights to the parents. If you overstay your visa, having a US born child will do nothing for you. The child can stay but you will still be deported. The child can come to the US anytime but you will still have to obtain a visa to visit, you cannot stay. When the child turns 21 years of age then the child can petition for its parents to immigrate to the US.

So if you are looking to obtain immigration benefits through the child you will have to wait 21 years.

And, for your future non-immigrant visa applications, it's important that you pay the entire cost of the birth (unless you have US health insurance that will pay for part of it) and not use any benefits, even if the hospital offers them. Then, keep the receipts so if you're asked you can prove you paid.

If you arrived on a visa like DV lottery or other green card visa then your child is a USC and your are still permanent residents. IF you are on a visitors visa or student visa the child is still a USC but it does NOT help you stay in the US. The child would be able to petition you when they turn 21 but until then you would either have to stay on other visas or leave.

This will not be over quickly. You will not enjoy this.
