Hi guys ... I abused a tourist visa ... I was in the USA for a year ... then a family emergency I was constrained to leave not knowing the use of overstay .. I'm waiting for my decision of the -130 when my wife had to receive approval soon will be able to send the i-601? ... I do not want to go to the consulate to see me then rescinded my visa .. I prefer to wait for the approval of the I-601 so .... sure that when I go to the interview I do not deny the visa .... what do I do?? aspect of the approval of i-601 ..? then casselario giudiziare must be translated into English? either is fine in Italian?. ... thank you for your answers ... that God will help you.

Exactly 3 months from the day we got married till the day I had both SSN and GREENCARD in hand !

Day 1 01/22/2013 AOS package sent

Day 8 01/28/2013 NOA 1 received

Day 15 02/04/2013Biometrics appt letter for 2/25/2013

Day 16 02/05/2013 Succesful walk in biometrics 20 days early

Day 25 02/14/2013 USCIS status changed to Testing and Interview ready for interview scheduling

Day 31 02/20/2013 Email notification that my interview is scheduled for March 21st

Day 57 03/19/2013 EAD/AP card ordered

Day 59 03/21/2013 Interview at 10.30 am Seattle Approved

Day 67 03/29/ 2013 Greencard Arrived . Applied for SSN

Day 68 03/30/2013 EAD arrived

Day 74 04/03/2013 SSN card arrived

Eligible for ROC December 21st 2014

Your English is far from perfect:) but that's okay.

From what I can gather, you want to know what will happen with your spousal visa since you overstayed a tourist visa. You must attend your consular interview for the I-130, and you will be denied. Then you can submit the I-601 and they will let you know when a decision is made on it. If it is approved, they will tell you to come to the consulate to pick up your visa (or they might mail it to you, depending on the consulate). You cannot wait for the approval of the I-601 and skip your I-130 interview, if that is what you are asking.

Correct except it's a visa interview, not an I-130 interview. I understood the question well enough as well, but it was stated very poorly with many English mistakes.

thanks for reply .. but excuse since my wife receives notification that they have accepted ... Pass about two months .. if not more that the embassy will call me..I so ahead of time .... I heard USCIS yesterday and they confirmed that since my wife receives the notification may deposit the i-601 .... then I do not know

Could you tell me what documents I have to bring to the interview .... need the birth certificate of my wife? ... original? ... I have with me a copy of the certificate of marriage ... would do the copy? I know ... I have to submit my record giudiziare .. must be translated into English?

Filing the I-601 between petition approval and visa interview is for foreign spouse's waiting in the USA. If I understand you correctly, your spouse is outside the USA already. Is that correct? This is where your grasp of English is failing you.

From USCIS.gov regarding Provisional Waiver Process...

Beginning March 4, 2013, certain immigrant visa applicants who are spouses, children and parents of U.S. citizens (immediate relatives) can apply for provisional unlawful presence waivers before they leave the United States. The provisional unlawful presence waiver process allows individuals, who only need a waiver of inadmissibility for unlawful presence, to apply for a waiver in the United States and before they depart for their immigrant visa interviews at a U.S. embassy or consulate abroad.

No, it doesn't work that way. The foreign spouse who is already outside the USA, must first go to the visa interview and have the visa denied, BEFORE the waiver can be filed. If you are having difficulty understanding you are wrong, please get somebody who is fully fluent in English to read and interpret these responses for you.

What about you write the question in Italian and I try to translate them so competent people can help you? Just PLEASE use correct punctuation and not a bunch of ........
