In Part 7 of the I-131 AP application, they ask: "On a separate sheet of paper, explain how you qualify for an AP Document, and what circumstances warrant issuance of advance parole."

I am about to file my Adjustment of Status from a K1 Visa, and I have read conflicting information about whether I will need to provide the sheet or not. (I have no specific travel plans for now)

What did those of you guys who have already had their AP approved do?

K1 Visa
Feb. 29, 2012: I-129F sent
March 8, 2012: NOA1 (VSC)
August 30, 2012: NOA2
Oct. 1, 2012: Packet 3 received
Nov. 3, 2012: Packet 4 received
Nov. 15, 2012: Interview - approved!
Jan. 18, 2013: POE New York Seaport
Feb. 2, 2013: Wedding

AOS
March 6, 2013: AOS Package sent
March 12, 2013: I-485, I-765, I-131 NOA's
March 29, 2013: Biometrics Appointment

May 10, 2013: EAD/AP approved
Sept. 5, 2013: "Potential Interview Waiver Case" letter received
Nov. 2, 2013: AOS approved (no interview)

Aug. 6, 2015: NOA1 (CSC)

Nov. 21, 2016: BBG approval notice received (p/u at German Honorary Consulate, OKC: Feb. 6, 2017)

Dec. 12, 2016: Priority Date (NBC)

Jan. 9, 2017: Biometrics Appointment

Aug. 31, 2017: In-Line for Interview

Sept. 6, 2017: Interview Scheduled

If you read further it says that people applying for AP based on a pending I-485 do not need to attach a statement at all. AP is routinely approved for people with pending I-485.

Hi Harpa,

first, thank for all your posts, they have been incredibly helpful!

second, nowhere on the instructions for I-131 or I-485 I find that it says that if you are filing both, then you don't need to include a statement explaining the reasons you want AP. Do you know if this is explained in some other instructions?

so ok what about part 3 in this form where they r asking about the date and lenght of the trip what if idk the date yet cuz i dont have any plans for now?? should i leave it empty?

Put 'Unknown'.

Look at part C, "copy of a USCIS receipt": What reciept is this? If we are filing for I465 with I-131 together, then how can we send a receipt if we don't have any receipt yet?

If you are filing it together, then no receipt is needed. If someone filed it after their I-485, then they would include the receipt notice from filing the I-485. No explanation statement is required for either situation.

Jay-Kay .. Are you speaking from personal experience ?

i am having the same issue as whether to include an explanation or not .. because i am thinking if i dont, and then at some point in the future they do ask for it as RFE, it wil just lengthen the process even more.. i called the USCIS, i was told to do as the instruction says, no specific advise..

The instructions say no explanation is needed.

Speaking from personal experience, yes. BUT, most importantly, speaking from reading the form instructions that were posted in this thread. No explanation is required when filed with a pending I-485. I have never seen anyone receive an RFE for such a thing. It should be a non-worry issue for you. It is not needed. Following the instructions works.

Agree with Harpa and Jay-Kay, from personal experience....you can make it more difficult for yourself should you desire, although it is not necessary. dry.png
