My wife just receive a letter for I751 interview. When we filed joint petition we were both together. Now we are separated with each having a protection order against each other. She moved out 5 months after we filed. The original petition filed was joint. I never withdrawn support from the petition. Is there anyway she could have changed this from a joint petition? I really want to attend the interview but I dont want to show up there if she changed the filing because I don't want to get in trouble. I have an infopass appointment next week. Would they tell me if it was still a joint petition? And would they make arranges for me if I wanted to attend?

You cannot attend with a protection order against you or against her.

You will go to jail for violating the order

Do you want to go cause you love her or you want to go to tell them you are divorcing.

You can tell them at the infopass appt

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

WHY would you attend? You are the USC, it's not your petition. It's likely she didn't change the filing because to do so would have required the divorce decree, and seeing you're not divorced...

Why do you want to attend? To support her or to stop the process? If you want to stop her process then you're SOL. If you have evidence of fraud submit it to ICE and USCIS and then move on. If you want to support her you need to talk to your respective attorneys about the OP's. Most likely they'll tell you to stay away, it's not your process, and she'll attend the interview and be told to change it to a waiver filing.

She is perfectly able to ROC without you and using proof of bonafide relationship as long as you are divorced. Her only other method without the divorce is to try and prove you divorced her AND show proof of bonafide relationship.

So, what is your goal? Why do you want to attend?

Yes, why on earth would you attend, especially when you have a protective order on her? Now you want to go see her? :S

It sounds like you want to lie and say you are together by going to the interview?
