That's what I was thinking of too when I've read all this!

You should have checked "Other (Specify)" and specify it as "I-129F"

I really hope you find out why it's been sent back. :idea: It's really weird that they didn't cash the money though...

I wouldn't be too sure about that. The G-325A is used for many applications and petitions. Its purpose is "To provide biographic information on an alien. You file this form only as instructed on another Immigration application or petition." (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=d7c84154d7b3d010VgnVCM10000048f3d6a1RCRD)

Since you haven't applied for the K1 visa yet you couldn't have submitted it in connection with the application for the K1 visa. Does that make sense? (Please note: I'm NOT sure that "I-129F" is correct either! It's what we put in but this doesn't mean that we're right :P )

Besides, I can hardly believe that THIS might be the reason for them to send your papers back... They SEE that your fiancee sent it in with the I-129F petition - and they KNOW that this can't be for the visa itself. I doubt that this is the reason. It would be different if you checked "Naturalization" or "Permanent resident"...

I was googling your situation and came across the classification sought only when looking at the I-129 instructions. Make sure he has the right form: I-129F

Also on the "other" section of the G325a put what form you're sending it with, NOT the visa you're chasing. The USCIS does not deal with visas. It deals with forms and petitions. The correct answer would be "Other: Form I-129F" you can include petition for alien fiancé if you want as well.

Do this yourself, not with a lawyer or immigration service so that you KNOW the paperwork is correct!!!!! Obviously they are messing up!

If they keep using the words "classification sought", it sounds like that USCIS can't determine what you are applying for. Maybe something is missing on the form, the wrong words are used etc. All of my research on "classification sought" refers to a particular type of visa, ie: they can't determine what classification to file your application under. Something is missing. I would post the exact wording of the letter.

I would definitely fire whoever did your paperwork.

And no offense, but if it was "all complete" then you wouldn't have been rejected, so obviously something is missing. I know it's frustrating but I would go over it again piece by piece. You'll figure it out. Good luck.

Alright, since you said you're still learning how to navigate this site I figured I'm gonna send you the link to the K1 Visa Guidelines (in case you haven't found this one yet):

As others advised: Go through EVERY step ON YOUR OWN once again! Ditch the immigration lawyer - I don't think he knows enough about this whole process (otherwise this shouldn't have happened!) You can totally do it on your own - just be patient and accurate and follow the guidelines. Redo it and if you're not sure about anything ask us. Everybody here is happy to help you! :thumbs:

In addition to that - it might be totally unnecessary - I'll explain the petition process in detail (since there obviously was some confusion about the petition / visa on your end):

- First of all your US citizen fiancee has to file the petition "I-129F". Check the link I just posted for whatever has to be in there ("Assembling the I-129F Package: Checklist")

- After she sent it in (to the Dallas Lockbox), they resend it to the Service Center that is responsible for you from now on. They're cashing your check as well.

- You'll be sent a Notice of Action (NOA1 - Form I-797C) - They're basically just telling you that they received your package and that they're going to review it. You get a receipt number and you can start tracking the progress on their webpage

- You either receive a RFE (Request of further evidence) or NOA2 in the next step (approx. 6 months later - or even more at the moment). NOA2 means that they approved of your fiancee's petition and USCIS sends your whole package to NVC who sends it to your consulate who tells you to apply for the K1 visa and send in further documents (That's the start of the VISA PROCESS - Everything that was BEFORE this step is just the petition.)

- I don't know about the following steps for Canada since it's slightly different from each consulate but you're not there yet - so no need to worry about that right now.

Where did your fiancée send the initial petition? And was it sent back from that same location, or did the office that received it send it to another office who then sent it back to your fiancée?

When you spoke to USCIS on the phone did you speak with a Tier 2 agent? The initial people who answer the phone are termed Tier 1 agents by many people. They have very little information--they can basically look up your case status online (which you can do anyway) and write a problem report for you. So if you want any real information you need to tell them that you want to talk to a Tier 2 agent--those are Immigration Officers with actual access to the case system and a lot more knowledge of how things work. (I think they're the same level of people you get to talk to if you set up an Infopass appointment. I was kind of annoyed that I had to travel hours to a physical Infopass appointment only to later learn I could have just asked for a Tier 2 agent.)

the only thing I can think of by googling "classification sought message for I129f" leads me to another post on this site where at the bottom of the G325A form they ask for what you are applying, the choices are

OTHER (PLEASE SPECIFY)

when we filed, we checked the OTHER box and put K1 visa as our reason

What address did you send your package to, if you mailed it to the wrong address, it would be returned with the check not cashed; wrong classification could mean you sent it to an area of USCIS that does not adjudacate fiancee visas. Based on all the information you have written, this sounds like the most likely result.

There was no issue as to the office...it went to Texas which is the office for Las Vegas.

Might well be what NikiR suggested: in the G-325A you should have put other: I-129F not K1...K1 doesn't exist at the USCIS, K1 starts to exists at the NVC when they give you a visa application number and send your case to the embassy. Before that you are not a visa applicant. You can become a visa applicant only when the I-129F petition has been approved by USCIS...

Hello All,

I am the one who prepared the paperwork in this matter. For the record I have been preparing immigration forms for over 8 years, and I have never had an application/petition denied or rejected. I also work with an attorney who has been practicing for 35 years.

We originally filed with the Dallas lockbox as described by the beneficiary in this thread. When it was returned I reviewed the package and found nothing wrong. I assumed it was a mistake by USCIS and they didnt notice it was an I-129F and not an I-129. I was especially suspicious of a mistake as USCIS has now twice made an error on the beneficiary's birth date. (which is correct on all forms) As such, we re-submitted with some clarification. As noted, and to my surprise they sent it back again.

I had an attorney review on this file this morning, and we are stumped so to speak, we have made an appointment with info pass, as well as emailed the Dallas lockbox facility for clarification.

I am glad, and even encourage anyone of my clients to obtain any and all information possible. I pride myself on helping people. I have been researching this issue every waking minute. (leading me to this thread) As such I reject the notion that the person preparing the forms should be fired, which has been said on this board. If it is found that a mistake was made on my part and not USCIS mistake I will gladly refund all fees paid. As I said, I only want to help people, and I will go the extra mile to help resolve this issue. Money is secondary to providing a great and reliable service.
