I'm Monica and I have been in the U.S. two years ago through the J1 visa which expires soon.

I'm getting married in couple months so I'm reading about the procedures to apply for green card and the first step says "J1 Visa holders will almost always require a waiver and Should Consult With An immigration lawyer or the USCIS for more information"

I wonder if anyone knows or knows of this case, if you could help me.

Does your J1 visa in your passport stated that you are subjected to 2 year home residency requirement?

And please stop creating multiple threads asking the same question.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Assuming the visa you had is a J-1:

Broadly, the guide you need is http://www.visajourney.com/content/i130guide2 as mentioned above.

Do not leave the USA from now until you have either advance parole (2-3 months from filing) or the green card itself (3-5 months from filing).

Check your DS-2019 to determine whether or not you're subject to the two-year home residence requirement. It's a simple checkbox.

Contrary to what was stated earlier, you can successfully adjust status even if you marry after your nonimmigrant status has expired, but in between I-94/DS-2019 status expiration (+ 30 days grace period for J-1, IIRC) and I-485 submission you would not be in legal status. In practice there are usually no consequences, but it's best avoided if possible so you should try to marry and file before your grace period expires.

The Op CANNOT adjust if she is subject to the 2-year Home residency requirement. Let her answer that first before saying she can adjust.
