The petition will be denied. The biggest requirement of the I-129f is that the two of you must have met in the last 2 years.

No Christian church law prohibits meeting before marriage.

It doesn't make sense that both Islam and Christian rules prevents you and your fiance from meeting while it is okay in Pakistan for a Christian to marry a Muslim???

USCIS did NOT approve your visa. USCIS approved your fiance's petition. Your visa will be denied. It is untrue that you can't meet due to religious differences. If you're christian, you can meet anyone prior to marriage, given some exceptions.

First of all - you posted in the wrong sub-forum (CR-1/IR-1). This should have been posted in K-1. If USCIS and NVC also approved your petition (not visa) that may or may not sway the embassy's decision to grant the visa. I am not aware of customs in Pakistan for Muslims that prohibit even meeting each other before marriage but I suppose in rural areas it's possible. For Christians this is certainly not true. In Yemen many K-1 visa applicants have tried to get visa approval without the meeting requirement but they are usually denied in the end since the embassy knows the culture well and knows that even though it's a strict and traditional society that meetings between a betrothed couple are allowed with a chaperone. If the same is true for your culture for sure the embassy is aware of it and they will deny the visa application.

USCIS does not have the power to approve visas. USCIS approves the I-129f that the petitioner is a US citizen who can file for a foreign fiance. That is all.

The NVC does not have the power to approve visas. The NVC collects the paperwork. The NVC makes sure that all the paperwork meets the basic requirements to send to the US Embassy. That is all.

The US Embassy/Consulate is the ONLY agency in the process that can grant a visa. The US Embassy makes the decision.

Can you please answer my questions?

What Christian church law prohibits you from meeting your fiance? If you can break the taboo of a Christian marrying a Muslim, then why can't you break the taboo about meeting before marriage?

Very strange that his family and your family can break the big rule about marrying outside your faiths but not the little one about meeting face-to-face before marriage.

Many Muslims go to Pakistan to meet face-to-face before petitioning their fiances, so it is done.

Your situation seems very strange.

If it strange enough for us, wonder what a CO will say. The fiance is really throwing away a lot of money in this journey.

Your I-129F petition will be denied at the USCIS stage. It will never reach the NVC. It will never go to the embassy. You have to have met in the last 2 years unless there is extenuating circumstances but you do not qualify for those. Meeting is a requirement of the petition. Also the USCIS will NOT accept proxy marriages so do not try to get married by proxy and then do an I-130 petition either. An NOA1 does not mean anything besides that the USCIS received your package, your money and will review your case. It will be denied, I guarantee you.

http://www.uscis.gov...000082ca60aRCRD

USCIS makes it very clear.

Eligibility Requirements

If you petition for a fiancé(e) visa, you must show that:

  • You (the petitioner) are a U.S. citizen.
  • You intend to marry within 90 days of your fiancé(e) entering the United States.
  • You and your fiancé(e) are both free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment.
  • You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:
    1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)'s foreign culture or social practice. (yours does not)
    2. If you prove that the requirement to meet would result in extreme hardship to you. (EXTREME) http://www.merriam-w...tionary/extreme

I suggest you and your fiancee meet. It settles that one requirement that you need to have. You do not need to meet in Pakistan or in the USA. Maybe a third country would be better for you two. I hope you guys can get it figured out if you truly intend to be with each other for the rest of your lives.

Now we are starting to beat a dead horse with a stick!

Adeel sorry to tell you but that is one of the requirements, regardless of your conditions be it religious, financial or Health Related you will have to show some sort of proof that you have met each other physically meaning pictures and proof that you are engaged!

Now that you have gotten past the easy part the difficult part is that they will do the investigation on what you have said to be it to be true! It might be advisable that you familiarize your self with the term "Administrative Process" its something that majority of the Pakistani Men are placed in if they are the Beneficiary. Please review the other threads started in the "portal" tab it will take you to the Pakistani Portal.

So, here's a problem, your fiance already lied in her petition claiming due to religious beliefs you can't meet. Now you say you could meet but for her own personal reasons she can't travel. That's not an excuse. Your petition will be denied. You will not even have an interview. You MUST met BEFORE she even sends a petition and you MUST prove you met. It goes within the petition.

What did she send out? If she didn't send anything else, but money, forms and a cover letter the petition will be denied and she will lose all the money.
