K1 VISA denied and return to NVC

I was here before to lay my complain on how i was denied of the k1 visa at the Lagos embassy. Anyway nothing from them yet...I don't know how long it takes for the case to get back to NVC.Thanks dwheels76 ,i finally know how to post new topic... Anyway if anybody has help for me,please assist me please..The age difference between me and my finacee is really far,is there anything we can do...

1. Age difference: I am 32 and she is 62, before i went to the embassy for the interview,she came once,but she have been in Nigeria since 2 weeks,she went back few days ago. Well the Co told me at the embassy that the case has to be send back that i was not able to Conviced her that the relationship is a bona fide relationship so ever since we are still waiting ....... And my finacee only contact the senator of her state that is all we have done so far.. Please can anyone advice me on what to do best!!!

age should not make a difference, but if it was the other why around it would most likely be ok.if the woman was 32 an the man 62 that mite work.you need to show evidence of the relationship, sorry for what happen to you guys.

That's a pretty big gap. We vj members usually suggest marriage for High fraud and specially African countries, but because of the thirty year old age difference, and the fact that she is literally an elder citizen, I don't know how that is going to help. Hopefully others can fgive you a better answer

That is a large gap even for Nigeria. What other red flags do you have ? Is she white ? Either of you married before or of a different religion ?

You must understand that the job of the officer is to decide that you have a real relationship and didn't just dup someone into applying for you. What did you do to convince the CO of this? What evidence did you present that your relationship is valid. A couple of short trips to comply with the letter of the law isn't going to do. Did she meet your parents ? What things do you have in common you enjoy together ? How did you present these things ?

This will not be over quickly. You will not enjoy this.

Time for plan B and I hope that you're not waiting for NVC/USCIS/Senator to do something.

We too were denied a K1 but we're getting married next month and will reapply.

I'm being overly stressed planning a wedding and the traditional shenanigans reminds me of why I opted for a K1 in the first instance. JeezuzHolyMutherOfKrist.

PS: Were you interviewed by a possibly AfricanAmerican CO?

That is a huge age difference, especially with her beyond child bearing age. The best way to overcome the CO's doubts is to spend a lot of time together. Can she move to live with you for a year or so, and you get married? I think that wouldbe a better option than trying another K1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It will take a couple months to arrive back at USCIS via NVC. If your service center is Vermont (VSC) you have a slight chance to be reaffirmed, if it is California (CSC)your petition will in storage for about 6 months and then you will be told it has expired. You can then refile a K1 or marry and file a CR1 which is a bit stronger than a K1 but of course no guarantees. At that time when you have an interview again you will still need to show strong proof of a bona fide relationship or it can be returned again. K1's are allowed to expire and that's the end of it, whereas a CR1 (spousal) does not and you would have a chance for rebutal (or appeal)and give it all you got to overcome the obstacle of the age gap.

You are in for a long haul and have plenty of time to collect continuous evidence to convince the next CO.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

It might have helped your case If you guys just got married instead......But what other proofs did you give to prove a bona a fide relationship. You have to look at it in the eyes of the CO.....Good Luck to you guys.

I dont if marriage will help this situation... She should move to stay with you for awhile like months. Cuz lets be realistic it will be hard to convince anyone that a relationship with such a huge gap is bona fide. Even if the elderly partner was a man
