I'm the petitioner and when I submitted the 1-129F forms to the USCIS I didn't send my fiance's birth cert because it wasn't required, it is required when she sends the paperwork in at the consulate. I was approved with no RFE's

A lot of misinformation on this post.

Off-Topic2.gif

No, the birth certificate of the beneficiary is NOT required to file the petition.

As A&B suggested, follow the guide and you will be fine.

There is misinformation in some of the posts above. Only the USC petitioner needs to send in a copy of their birth certificate, or other means of proving they are a USC. The foreign fiance(e)'s birth certificate is not required until after the I-129F petition is approved and they are applying for a K-1 visa at their local consulate. Follow the guide A&B linked to.

Thanks everyone for your replies! I didn't anticipate to receive so many replies.

Ryan and Jay-Kay, thank you for the clarification! I love you guys! hahaha. I will follow as you mentioned. I was a bit confused before, because VJ step-by-step K-1 visa guide didn't mention fiance (beneficiary) birth certificate for step #1 procedure, and other sites state is required.

Have a great Thanksgiving!

I about had a heart attack reading the first couple of replies to this post! Can a mod edit out the misinformation? I'd hate for somebody to unnecessarily panic if they didn't read all the way through the thread or got confused.

I suggest everyone always read through an entire thread because misinformation gets posted all too often. Thankfully it is usually corrected.

My biggest confusion is to why people gave the posts with the wrong information +1s
