Ok here is my dilemma I have the money to file the petition myself but my fiance was deported before so I'm not sure if it would be wise to do it alone.

I was going to start the petition in January when I had the money for a lawyer but I'm sick of waiting.

What do you guys think.

Should I do it alone or wait until I have the money for a lawyer.

He was arrested for a traffic ticket nothing more. He's been in Mexico almost 3 years already

What kind of visa was he using then? Did he overstay in the US?

What was the infraction? They don't just arrest subjects for a traffic ticket. Was it more serious then speeding? Did they pull him over and run his name to find out he was here illegally?

drving on suspended license was why they arrested him. We live in arizona by the way so no need to be doing anythoing to get pulled over here.

he never had a visa his parents brought him here in 1997.

What kind of visa was he using then? Did he overstay in the US?

Oh okay. So, they pulled him over, found out he had a suspended license and then found that he was here illegally and deported him?

It might be in your best interest to wait for a lawyer. Sounds like there will probably be a entry ban for him. At LEAST consult with a lawyer to figure out your options because waivers for this might be difficult.

He got deported because he was staying illegally in the US. He wasn't deported because of the traffic ticket.

Wait until you can afford to consult a lawyer.

I've spoken with a lawyer already and he told me it could be possible.

I just want your guys opinion on if its a good idea or not.

If I were in this situation, I would use the lawyer. He/she will, or should, know what to do in this situation. I would also expect to pay serious money as I am sure, yes, it is possible for a waiver BUT it could be difficult to obtain.

Your case is the exception to the DIY rule from this community. You are better off getting a lawyer.

You can always try doing it yourself; but when they deny the petition or when they deny the visa (whichever comes first), you will lose money and time (lots of time.... months).

he wasn't deported because of a traffic ticket or driving on a suspended license, he was deported because he was here illegally. You need a lawyer because he will have a ban, this is not a case you should do on your own, get a lawyer, a good one.

I agree with others that he wasn't deported because of a traffic violation, but rather hi being here illegally. You need to get a lawyer!

My suggestion is to research like cases in your area. Chances are being in Arizona there will be many like your fiancee's. Of course Lawyers want our business and most will promise or take your case and make an attempt to win it for you. However you must keep an open mind as to not waste your money if you cannot win. Once again, research similar cases and see what the % of winning a case is. Then move forward if you believe you can win this. Chances are if he was brought here as a minor then you have a chance at winning in the event he has not been arrested or convicted of a felony.
