Hey Visajourney guys, I got my two years conditional visa IR1-cr1 around a year ago, and now about to start filing for the AOS, I need to know almost everything about that, like, how much should me and my wife make per year (we are not making big money but we both work and live pretty ok) , also, I heard some stories about sending back people to their countries to refile papers in there, is that true??? Emmmmm, what else, any information could be helpful!!! I apreciate your help in advance guys and wish everyone good luck :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm confused. If you have CR1, then why do you file AOS? Wouldn't this be ROC? Or am I sleep deprived?

Is it true that sometimes they send people back to their countries to file the paper work thrue their embassy ??? I mean, is it the with the mariage visa or its just with oher types of visas?

Dunno, thaught that I should file foe adjustment os status!!! That why am here, to ask you guys :))

I think you are confused - either by what visa you came on or by what you need to do.

If you came on a CR-1 you have a green card. You don't need to AOS. You need to file for removal of conditions no earlier than 90 days before your 2-year card expires.

If you came on a K-3 or K-1 you need to AOS.

Do you have a green card already?

Moved from Adjustment of Status from Family Based Visas to Removing Conditions on Residency Discussion. Based on the information provided by the OP in the first post, the OP needs to file for Removal of Conditions (ROC), not Adjustment of Status.

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

yes, conditonal one, good for two years .

Adjustment of status is to get a green card. Those that enter the US with a spousal visa do not need to file for AOS. You will need to file for removal of conditions within the 90 day period before your green card expires: http://www.visajourney.com/content/751guide

thank you for all those information, guys!!! I apreciate all of that .. I got a good idea about the paper work I gotta submit and everything , still have the same question wich I didn`t read any about , is there any cases they will reject the case and ask me to refile again from the tunisian embassy ( just trying to save for a trip like that if yes) , because I heard that they do that in some situations, I dunno if its the same with the CR1-IR1 visa! thank you again million times :)

I have not heard about asking someone who is removing condition to go to their country...just follow the rule...which is file during the 90 day window...filing jointly and submit all the supporting document...you may be approve without an interview...or they will call you guys for an interview...

Well, to lift the conditions are so you can have a 10 year greencard is basically proving that you're still married and you still have a bona fide/genuine marriage. If you cannot prove that, then yes, the application will be denied and you are deportable. There are other reasons such as not maintaining your residency, failing to show up for biometrics appointment/interview or responding to time sensitive mail from USCIS. But please don't jinx yourself; simply follow the guide on Visa journey or read the instructions for i751.

USCIS mentions some of the documents you can provide, the Visa Journey guide covers most of the documents, as well as how to essemble all the papers.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

You're already a permanent resident, so unless you were denied for something like misrepresentation, fraud, etc. you would be able to refile. The only possible issue (extremely, extremely slim) is if you were out of the country already and a denial occurred. I'm honestly not sure what would happen in that scenario but again, that is very very unlikely (particularly if you aren't intending to travel abroad while it is processing).
