my wife and I had a disagreement then she canceled the file,thanks god we came back together again .when she canceled the file she got a letter saying she can not appeal the file. so what does mean that?and whatcan we do to be together .thank you so much

She cancelled the file...???

Do you mean she withdrew her petition...???

If so, she can file a new petition on your behalf.

Cancelled means she withdrew the case. That case is now finished. She will need to begin again. However this time you will have serious problems with the embassy due to the nature of the cancellation. Your country is one of the most difficult to deal with if all is well with the case. This red flag will carry a price.

To be togther prepare for a long difficult journey together. You can do it with the correct understanding of your situation.

I kind of wonder about the USCIS system. I've been wondering about it for a while.

SUPPOSEDLY: Scenario, you as a Moroccan, was a beneficiary and the petitioner had cancelled the application. Then one day down the road, you want to marry a USC (United States Citizen). This USC applies as a petitioner and you as a beneficiary - AGAIN. Your name may appear in the system and you COULD/WOULD be considered a "MENA" red flag. There are high chances of denial in the process - or so I WOULD humbly "ASSUME".

I'm married to a MENA man. Our applications have almost been withdrawn a few times. We've come to realization that it was our cultural differences that were causing us problems, NOT because "it is who we are"... The distance was hard enough! Factor that in!

I do not want to generalize but... MENA men are usually INFLEXIBLE, RIGID, tempermental, impatient, and these undesirable traits come out glaringly from time to time. They say LOVE has nothing to do with this, happiness has nothing to do with this. They do this for the sake of fulfilling their "islamic duty" as a husband to "maintain" their wives. Honey, the role shifts some here... for the sake of love and survival.

GOOD LUCK with that here in USA - maintaining their wives is hardly going to be the priority issue here. It'll be keeping a roof over your head, keeping your marriage together, learning new cultures, expectations and everything. You'll WANT your loved ones to maintain themselves and take care of themselves while you struggle for a while to "sink or swim".

Thank Goodness my man has relaxed a bit and learned to be flexible.

MENA men?

well, if there were more folk telling you to file a new I-130, then you'd have more suggestions saying the same thing.

I am asking, I don't know: Would this really cause an issue with USCIS? I thought for the most part they just checked that all the paperwork was in order and that background checks were done.. A previously withdrawn petition should never cause a denial at this stage..

That information would be available at the final interview and the CO will act as they see fit with the totality of information..

Darnell is correct, there are no other suggestions. She must petition you again, must pay the fees again, and you must wait again. If she can. visit again before filing the second petition and a couple of tiomes during its process would be good- you are going through one of the most difficult consulates, and now have an extra red flag, so approval will be difficult.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

One of the big differences is that USCIS is, in most cases, a paper-only process. You submit all the correct papers that appear to support the relationship behind the petition and the petition gets approved. DOS has the job of verifying the relationship is real and not just a paper one. The two are supposed to be a balance to one another.
