Hello everyone,

I just joined this today and I can already tell that I am pretty behind on understanding this whole process... Anyway I received my NOA March 12th from the Vermont Servicing Center. I know its not even close to the 5 month mark, but I'm currently pregnant from my last visit with my Fiancee. I know their are million SOB stories in the world but I just wanted to see if anyone had any idea about the whole expediating process. I'm due in Oct. I would give anything for him to be able to be here for our daughters birth. On top off that I am starting to face financial hardship (I'm a student). Friends and family are telling me to file for some assistance, but I don't want to look at that option because I am scared that it will effect our petition... Anyway does anyone think this qualifies as an emergent situation?

You can try to have your case expedited. Pregnancy is generally NOT a reason for expedite, but there is no harm in trying at all.

Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

Severe financial loss to company or individual

Extreme emergent situation

Humanitarian situation

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

USCIS error

Compelling interest of USCIS

Have you secured a joint sponsor for your fiance? You will have to submit an I-134 regardless of income. If your income does not meet the requirement then a joint sponsor (also called a co-sponsor) will be needed.

Your fiance will not be able to work in the US for several months after arrival. So expediting wouldn't solve the financial concern. Pregnancy does not meet the criteria.

You using any sort of assistance will not have an impact on the visa decision.

I was unable to get any favor for getting my husband to the US in time for the baby's birth, so yeah, unfortunately, regular pregnancy is not usually an expedite-worthy request. However, sometimes, in a few rare cases, I've seen people granted expedites because their pregnancy became complicated (i.e. mandated bedrest, risky surgery needed to maintain baby's or mom's health). Just this week a friend was denied an expedite on the grounds of a pending C-section and the need to have her husband there to help with recovery, so unfortunately that isn't usually enough.

As far as filing for assistance, this can't specifically affect your husband in any way and really might be necessary if you're facing hardship. However, you'll want to make sure that you have someone (family? friend?) who can sign the documentation (I-134?) to pledge to support him financially if he is unable to support himself in the US. If you're facing financial difficulty now, it's likely you wouldn't qualify to be his financial sponsor anyway, with or without filing for assistance, so just make sure to get someone who is willing to stand as a financial sponsor.

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

Assuming it's allowed for K-1s to have one at Lagos, do you have a co-sponsor identified for when it's time for your fiancé's interview? Since you're pregnant, that will affect your household size for the I-134. With your household now being three (you, your fiancé, your child), it would be $23,862 at the 125% level, assuming there are no other children. If you're having financial difficulties now, it's best to start thinking ahead.

My fiance once tried to email USCIS for expedition of our case coz im preggy too and theres no harm on trying :) .. but still they can't expedite it coz pregnancy is not medical emergency . So we are just waiting for the whole process, and still waiting for the case number from the NVC. Im due this Aug 23 and expecting to give birth here in PH.

Thanks everyone for your response I figured it would be a long shoot. I have my mother and my brother to help with the I-34 so Im ok there. I figure that pregnancy wouldnt be enough but its getting miserable waiting as you all know. Thanks that for the responses.

We aren't going through Lagos we are going through Abuja. I didnt even check though if they didnt allow the I-34, I didnt realize it was country specific. Im so behind and feeling overwhelmed

You are not going through Abuja only Lagos handles K1's and CR1s

This will not be over quickly. You will not enjoy this.

Does your brother live with your mother ? If not only one of them can be the co sponsor. You are the primary sponsor no matter what your income is. You are allowed one co sponsor per immigrant and that person may combine household incomes only if they reside together as a family unit.

This will not be over quickly. You will not enjoy this.

No they don't and ya I know they can co-sponsor. I meant I can ask either one of them to help. My financial hardship is recent anyway, and hopefully wont last too long

Why do they give you the option on the application to pick Abuja or Lagos/

What Application are you speaking of the 129F? There's no choice in City on that it ask,
