If the US citizen petitioner has zero income then the joint sponsor should use form I-864 no matter the relationship.

The petitioner also does an I-864.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Sorry to bother you but what I-864 form will i use if i am a full time college student but started working at a month ago with an income of $ 440 weekly before taxes?

What is the situation? Seeking a visa (what type) or adjusting status?

I filed the petiton I-130 for my spouse and it has been approved and sent to NVC. I payed my AOS bill online and i have my I-864 COver letter so im filing out the I-864 now but don't know which form yet. also I don't know how to calculate my annual income since i started working a month ago and make $440 a week before taxes. I don't know if i should calculate how much i make after or before taxes. Also if i should multiply my weekly income by the number of weeks in a year or by month with 4 weeks in each month it's a bit confusing

You complete the I-864. Take your weekly gross (before taxes) and multiply it by 52 to get your annualized income.

They'll probably still ask you to get a joint sponsor. The requirement is that your income must be sufficient in the year you file the I-864. Since you will only be working half of the year then your income will only be half that amount.

From the Adjudicators Field Manual:

When determining the sufficiency of a Form I-864, USCIS shall first consider the sponsor’s anticipated income for the year the sponsor signed Form I-864. Thus, during the initial evidence review, USCIS shall as a general rule determine the sufficiency of a Form I-864 based on the sponsor’s reasonably anticipated household income for the year in which the sponsor signed the Form I-864.

There have been more than a few VJ members who've gotten an RFE for a joint sponsor even though their annualized income appeared to be sufficient. The common thread in those cases was that the sponsor hadn't been working since the beginning of the year.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I have a similar situation here yet have a question about I-864A.

The sponsor is a 60-year old housewife with no income living with her sister and her sister's husband. (same residence)

The sponsor relies 100% financially on her sister's family.

I know the sponsor needs to fill up a i-864 form stating no income no matter what, but what about her sister/her sister's husband living at the same address as her joint sponsor?

A or B or C?

A. I-864A (contract between sponsor and household member): Since the joint sponsor is the household member living at the same residence, s/he in this case should count as I-864A HOUSEHOLD MEMBER?

B. I-864: No matter what, the joint sponsor should file with I-864 whether they are living at the same residence or not?

C. Both I-864 and I-864A: As a joint sponsor, s/he needs to fill up I-864 and since s/he is also a household member, s/he is required to fill another i-864A?

Since the primary sponsor has no income, there is nothing for a qualifying household member to combine any income with. In that case, it is best for the joint sponsor to fill out their own separate I-864 instead. So B., the sponsor fills out their I-864 and the sister or brother-in-law that is going to be the joint sponsor also fills out an I-864. It doesn't matter if they live together. You do not have to fill out an I-864A just because you live together. If the joint sponsor claims the primary sponsor on their taxes, then they need to include her in their household count as well, so just be aware of that.

Now then, if the sister or her husband qualify for their household size plus the intending immigrant with their own individual income alone, then all you need is one of them to fill out an I-864. If they need to combine incomes to meet the 125% for the household size count, then one of them can fill out an I-864 and the other an I-864A to combine their incomes.
