Hello all,

Thanks for all the info through the last couple years.

Looking for some new direction.

She arrived from Thailand on a K-1

Married 7 months.

She has recently received her green card and ssn.

And yesterday left for greener pastures.

We would qualify for “summary dissolution”, no children, joint property, ect.

But she does not want to divorce the money cow.

How can I learn what to do next?? This has gone past the point of reconciliation.

1. Stop being financially responsible for her escapades

2. Can immigration help

Sorry to say it, but IMHO, from what you have said..... I would suggest that you cut your losses, cut the ties, and move on...file for divorce.

1) Change locks, change credit cards/banks/utilities, file for divorce

2) Help to do what? They are not going to deport her for you. You can report her to them and provide hard facts (not from a position of a vindictive Ex syndrome) and they may consider it when it comes time to ROC.

Good luck. I really wished you Guys would provide more details of the relationship so others would learn from it.

PS: You do know about the I-864 that you signed right?

I've seen more of this out of Thailand lately. The old scam was to suck as much money out of the USC while still in Thailand, and then bail out of the relationship right before the interview. Wish they would have stuck to the old scam.

For what i can read you guys were married for 7 months only so she still have a conditional residence card.

so after her 2yr green card expires she has to apply for I-751 Petition to Remove the Conditions of Residence.

You guys both need to sign and prove that are together unless she was mistreated, and can apply for a waiver.If you do not sign it then she becomes out of status and will be subject to removal from the US or you can call ICE in case you wanna go to that point.Then You will no longer be financially resposible for her.You can also let the USCIS know about your situation i did something similiar in the past and was able to request a withdrawal.

for two, if she has the conditional, im pretty sure u can tell uscis that the marriage was fraud and then u cant do much.

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

This seems to be a recurring story line, the USC signs the I-864, the immigrant gets the conditional GC and leaves. The USC is angry and wants her deported which is not terribly likely to happen. Everyone says tough luck, now you are on the hook for ten years. But hold on a minute. Unless she has the ammo for a VAWA, the I-864 can effectively be terminated with her going out of status and it doesn't matter for you if she stays on illegally, avoiding ICE. She cannot very well be getting 'means tested federal government benefits' when she is out of status can she? So it seems to me that it now becomes critically important for the USC to make certain she cannot get ROC on her own. Make sure that USCIS has every bit of information that you can provide to help them deny her that 10 year GC! Don't worry about whether ICE catches her and sends her back. The really important thing for you is not getting financially hammered by the I-864. Am I right here or am I missing something?

sorry for the heart ache in all this...BUT some people need to follow their MIND NOT THEIR EYES and dont think with the wrong HEAD :thumbs:

March 19th - received NOA

April 13th - Biometrics

May 03rd - notified of interview (06/13/2012)

May 06th - received interview letter in mail

May 11th - received notification of EAD card in production

May 19th - EAD in hand

May 23rd - Applied for SSC

May 29th - Received social security card in mail (card in hand)

June 13th - Interview (approved on the spot)

June 13th - got notification of approval

June 18th - Card in production (also received welcome letter in mail)

June 21st - Green Card in hand

End of this journey....
