Over 7 Months, no NOA2 Yet

Hi everyone, been lurking around the forum for months but first post.

Getting frustrated, filed I-130 on Nov. 7, 2011, and still no NOA2 yet, got my NOA1 within few days that case was sent to CSC.. Still says case under review when I check status on USCIS website.

I called USCIS in mid April after my 5.5 months of wait, and they issued a Service Request based on my behalf, and was told to wait 45 days and that my case is being adjudicated. 45 days have come and gone, and nothing. Called again and they state all we can do is issue another service request. Getting really frustrated.

I've now contacted my local congress woman and one of my senators. Also scheduled an Info Pass for next week. Anyone else out there from November still waiting?

I don't get it, I'm a U.S. Citizen, no criminal record of any sort, neither does my wife, she's never been to the U.S. She's a doctor back home also no suspicious activities or anything. It seems everyone from November has had NOA2 approved and some ending stages of NVC process.

I have seen other people suggest reaching out to your Congressman for help.

Good luck to you.

Agreed. Contact your state representative and/or senator.

Their liaisons will make a congressional inquiry on your behalf. Hopefully, their efforts will have a successful response.

Hope this helps you some. Good luck and keep us posted!

One of my friends had a similar situation happen with him. His name happens to set of red flags and blue lights where ever he goes. His visa process for his wife also took a bit longer then anticipated just because of his name matching from a list of some sort. And he was also born here so there was no issus just an association with names similarity. But just hang in there you have already started the procedure with the senator and congressmen.

You could also try sending an email to your service center. It seemed to have worked in my case.

Here is an auto-reply which may help you write to them more effectively:

The purpose of this account is to assist petitioners, applicants or their authorized representatives who have contacted the NCSC number (1-800-375-5283) with an inquiry but feel their inquiry was not adequately addressed within 15 days or who feel that the response received from the National Customer Service Center (NCSC) was not sufficient. This auto reply message will serve as a record of our receiving your inquiry. The CSC NCSC Follow Up e-mail account will try to be responsive to all requests. However, please note that you will not receive a response to your inquiry if you did not first try to resolve your issue by contacting the NCSC, or if you are not the petitioner, applicant or a designated representative of the case you are inquiring about.

Also, please be informed that this email account is available to petitioners and/or their authorized representatives who have urgent inquiries involving Form I-129 “O” or “P” petition. Therefore, if your “O” or “P” petition inquiry relates to an emergency situation, it will not be necessary for you to contact the NCSC.

If you are asking for a status update you must contact the NCSC. We will not respond to your status update inquiry.

In order to assist you in a timely manner, please include the following information with your inquiry (Send a follow-up email including this information if it was not included in your first request to this e-mailbox):

· The service request management tool (SRMT) inquiry number that you were given when you called the NCSC,

o If you have called the NCSC and they informed you they are unable to complete a SRMT please provide a brief explanation.

· The date that you contacted the NCSC,

· Your name and receipt number and/or A-number, and

· If available, the name of the NCSC Customer Service Representative you spoke with.

The California Service Center will review your e-mail and respond through this e-mail account or through the US Postal Service.

If you feel the decision on your case was made in error, to protect your rights you must follow the regulations and file any necessary motion or appeal within the allotted timeframe.

To agree with others on this post, definitely contact your representative in the U.S. Congress or your U.S. Senator (NOT your state senator - it has to be a federal rep.) I used to work in the District Office of a Congresswoman and we had a caseworker who helped dig up answers for frustrated constituents looking for information. Remember, those people can't make miracles happen for you, but what they may be able to do is get someone at the agency you're trying to contact to get off their butt and give you a more direct response than you can get on your own. Good luck!

Was just wondering if after contacting our Senators or Congressmen for expediting the process at USCIS step , if the USCIS officials might write some negative notes to the respective case holder(due to grudge) and it might haunt us later at the interview stage at the embassy. Who knows, the interviewer at the embassy , might read those notes and it could affect our case in the long run. Just my opinion, as I am also about to cross the 5 months mark too.

Thanks

Totally Agree on your think process of TRANSPARENCE .....

there might be different reasons but some times Just NATURE/TYPE of YOUR NAME and COUNTRY creat a BIG RED flag on background check and they have to re-do it and go DEEP.....Case gets even worse if you are NATURALIZED USC as they might not able to get whole details of your past generation from native country....

I know its FRUSTRATING but you did all things STEPS by STEPS to resolve. so, contacting your local congress woman and one of my senator should be BIG help....Good luck...

The only thing I can suggest is to contact OMBUDSMAN (if you already did it, thats Great as you already have InfoPass appointment)....down the row, it might help to expedite your case (USCIS ERROR)....

I'm stuck on background checks & have contacted everyone for help & STILL the same answer PENDING! I have been waiting for over a YEAR & STILL no NOA2 appoval... & you thought you had it bad.... :(:help::bonk::crying:

I'm in a nearly identical situation as you, except I am a December filer. I don't understand why so many in January and February are completed. I understand some get expedited and everything, but using VJ timelines:

February is 44% complete. (16% Complete at VSC, 60% at CSC.)

January is 64% complete. (41% Complete at VSC, 76% at CSC.)

December is 72% complete. (87% Complete at VSC, 72% at CSC.)

November is 81% complete. (100% Complete at VSC, 79% at CSC.)

October is 84% complete. (69% Complete at VSC, 85% at CSC.)

September is 87% complete. (77% Complete at VSC, 93% at CSC.)

I am guessing yours is at the CSC. So why would 60% of February be done at the CSC, when November remains 21% unfinished? To me that is crazy, and the annoying thing is, you'll never know why.

***update***

had my scheduled Infopass appt today, and they were of no help. The agent who helped me flat out told me they were no different then the people at the 800 number. All she did was type in my WAC in computer and said it's still under review, WOW! what a colossal waste of time.

I contacted by my congresswoman and senator and both said they had not heard back from the USCIS. It's been over 2 weeks. Highly frustrating, if a congressional inquiry isn't getting it done, I'm losing all hope.
