Over 7 Months, no NOA2 Yet

***update***

had my scheduled Infopass appt today, and they were of no help. The agent who helped me flat out told me they were no different then the people at the 800 number. All she did was type in my WAC in computer and said it's still under review, WOW! what a colossal waste of time.

I contacted by my congresswoman and senator and both said they had not heard back from the USCIS. It's been over 2 weeks. Highly frustrating, if a congressional inquiry isn't getting it done, I'm losing all hope.

Dont lose hope. I know this dont help, but it will come, and it will come when you least expect it.

Hang in there with the rest of us still waiting at or past that 5 month mark....... :blush:

I'm stuck on background checks & have contacted everyone for help & STILL the same answer PENDING! I have been waiting for over a YEAR & STILL no NOA2 appoval... & you thought you had it bad.... :(:blink::help::bonk::crying:

:wow: This is insanity. Your case deserves to be at the top of the pile, as you've waited way too long. :angry: I cannot believe that there is no one who can help you. I've been waiting for over 4 months now and was tired of that, as it seems all other February filers except me are getting approved.... but your case takes things to a different level altogether. I would start demanding some answers, and insist on talking to a supervisor. (Although I've been polite thus far, after 8+ months of waiting I would start getting far more demanding.) Please keep on their backs to get your work done. Also, there is no reason for couples to be apart for so long. If you can take some time to go overseas and be with your spouse, please do that. I've been apart from my husband for 3.5 months already and it will be another 6 months before we get to meet again. All these months apart really take a toll on one's relationship and cause strain. It feels so nice to go back and see your spouse and be in his/her arms again. Best wishes to you!

can't you take them to Court if there is no decision at all for lets say one year ?

If they take my $420 and run with no decision, the USCIS will here from my Lawyer. and yes, they will pay for my Lawyer fees also.

by law they have to review your case and give you a decision in a reasonable amount of time.

you are 100% correct. If that $420 hinged on a case decision, they'd be hauling butt fairly quickly. But they spent no time in cashing my check, but so far been 8 months and counting and all they can say is, "yeah we're working on it."

can't you take them to Court if there is no decision at all for lets say one year ?

If they take my $420 and run with no decision, the USCIS will here from my Lawyer. and yes, they will pay for my Lawyer fees also.

by law they have to review your case and give you a decision in a reasonable amount of time.

I actually heard this was possible. My husband's attorney told him that it will cost him though.

What you heard about is a Writ of Mandamus. If such a writ was issued by a court to USCIS, it would compel USCIS to render a decision on the file.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Over a year! wow, I'm so sorry to hear that. I'm going nuts after approaching 8 months. Have you gotten your congressman and/or senator involved?

I have contacted all of the above for help:(

And filed many service requests & STILL PENDING under background checks!

I miss my spouse soo much! Its just not fair! :crying::bonk::(:blink::angry::help:
