Hello, My wife is Filipino and I am US Citizen. We would like to know if she can petition for her mother to the US? I am not sure what visa that would be under. My wife has her green card. Will that allow her to petition for her mother to come live with us? What if anything is possible to accomplish this for my wife?

thank you,

Michael Cote'

Only US citizens can petition for a parent. You also can't petition for her mother because US citizens can't petition for in-laws.

Once she becomes a citizen she can petition them for an IR-5 visa. That will take close to a year. Is she eligible for citizenship soon?

Hello,

thanks for your help. If she can't petition? Can her mother come here on a work visa and stay with us? My wife has two more years to become a US Citizen.

thank you

Michael

Sure, she has a job offer?

Nice thing about work visa's is that the Employers Lawyer does all the work and incurs the cost.

What sort of work does she do? Most work visas require an advanced degree in a field that's short of qualified employees in the US, and she has to find a company to sponsor her. There are some temporary visas for less skilled work or for work training, but those specifically prohibit the applicant from having any intention of immigrating. She might have a tough time convincing a consular officer she doesn't intend to immigrate given that her daughter is an LPR who will be eligible for US citizenship in two years.
