I submitted a I-130 for my wife and stepson in March. I sent two checks($420), one for my wife and one for my stepson. One check cleared my bank and the other one was mailed back to me. Did I make a mistake? I thought there was a fee for each person. Can anyone help.

did you submit one i130 packet for each of them? petitions are filed separatly, so one i130 each, with payment and copies of documents.

As the previous poster suggested you probably only filed one I-130 petition. If this was the case you will need to file another I-130 petition for your step-son. Under section D question 1 make sure to list your wife.

You will continue to have two separate cases throughout the whole process and will be required to pay two fees for everything with one exception, the Affidavit of Support fee only has to be paid once as long as the cases are tied together by the NVC.

I was given an RFE by the USCIS for not including a copy of our marriage certificate with my step-daughter's petition so make sure when you send off the petition for your step-son that you include a copy of his birth certificate, your marriage certificate and divorce certificate if either or both of you were previously married.

I did not. I included him on her application.

HE NEEDS HIS OWN PETITION, so get busy this week.

The good news is that you can ask that HIS casefile be joined up with the MOTHER's casefile, referencing the Receipt # from the mother's receipt notice, in a cover letter (and include a copy of the I-797-C form on yer wife) submitted his HIS I-130.

I am filling out his G-325 and at the end where it ask for signature does he sign it? He just turned six and doesn't read or write. I hope I can sign because he and his mother are still in Ukraine. Thanks, Phil

Mailed out his packet today. Hope it goes through without his mothers signature. I did write she would sign at interview.

I do not think you need to file a petition for your stepson if he is less than 18 as he is on the petition you filed for your wife and that's why you paid only for your wife 's petition.You can call USCIS for more information.

Wrong. Wife is an immediate relative visa category. No derivatives are allowed. A separate petition is required for each immediate relative. K visas and family preference visas allow for derivatives.

I was talking to my wife about the G-325A and she told me the fathers name listed on his birth certificated is a generic name because she didn't want the fathers name on the BC. She said this is common in Ukraine. Has anyone else run into this? What should be listed on the G-325A?
