Hi all,

I just wanted to post to see if there is anyone out there who is or was in the same situation as us.

We met while both working in Australia and lived together here for 2 years before my fiance moved back to the US. In September 2011 we applied for an I-129 for me to go and join him. We are struggling to prove we have "met" as the usual proof of boarding passes/ passport stamps isn't hugely relevant to us.

We sent in photos and a lease which we are both on as tenants, but didn't keep any boarding passes as we didn't look into any of this until after we decided to move to the US.

So, I just wondered if anyone has been in this situation as we have just received an RFE for proof that we have "met". We have copies of passport stamps from trips together and each have pay slips addressed to our apartment but wondered if anyone has other ideas of what else we can include.

Thanks in advance for your help!

Hmmm... Bank statements showing transactions in the same area? You would think a lease would be pretty solid evidence! Good luck, i'm sure others have been in the same situation and will comment.

Passport stamps of trips together are great. I'd make copies of both passports, front to back. If there are many stamps, then include a paper highlighting the dates and year you traveled together. At this point the stamps do not need to be recent - as long as they are within the last two years.

ATM receipts and bank transcript showing you have been in the same area, the USC's credit card used in Aussie.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Click timeline or "about me" for all details.

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

Ahh, I see. Perhaps the lease didn't seem official enough, like it was homemade. You have other good suggestions here. Good luck!

Hi, thanks for the suggestions. We sent in the lease and have now received an RFE for more evidence, so clearly it wasn't sufficient.

Thanks

Did you send copy of your passport, photos of you two together? The passport showing you being there is big. And even though photos are considered secondary, they do carry some weight.

You received post mail at this address, it is stamped and dated? Utility bills at this address? Pay stubs, showing you both work in same area? Bank or credit card withdraws from common areas? Car registration?

Passport stamps for the US Citizen entering Australia would be the primary evidence of meeting, as would any credit card receipts for purchases by the US Citizen in Australia. Actually, they are looking for evidence you were in the same country at the same time, so since you live there, the passport stamps for entry and exit are generally sufficient primary evidence. Your RFE will have spelled out what they consider "primary" and "secondary". Correct?
