I'm in somewhat of a predicament...

On both the G-325a's that I submitted in my packet, I realized that the copies I sent were only halfway filled out. They were signed of course (original signatures) and they had the work history and location history but we left off our names at the top, and birthdates (basically the top 2 rows of the form).

I'm hitting my head against a wall that I did this. I'm going to contact my girlfriend in Moldova today and try to Western Union some money to her and have her fill out a new form and DHL it back to me. Should take about a week to get here, but it's probably going to cost me $200.

I only sent in my form on Monday and have yet to get my NOA1 (I'm guessing that will come on Monday/Tuesday of next week).

Anyone have any advice or experience with this? What will happen?

K1 Process -

1/30/12 - I-129F sent

2/2/12 - NOA1 Received (CSC)

2/3/12 - Visa App Fee Check Cashed

6/18/12 - NOA2 Email Received at 9PM MST

6/22/12 - NOA2 Letter Received in Mail

7/11/12 - NVC Received

7/13/12 - NVC Sent Case to Moldova Embassy

7/18/12 - Packet 3 dropped off to Embassy

7/19/12 - Packet 3 & 4 Instructions Received from Embassy

7/23/12 - Medical Exam Passed

7/27/12 - Interview

8/4/12 - POE Denver, CO

9/14/12 - Wedding #1 (Denver Courthouse)

9/17/12 - AOS/EAD sent

9/19/12 - AOS/EAD NOA1

I am pretty sure that they are going to send it back. The whole packet. Names and Birthdays are pretty important to the United States USCIS. I have heard people get their stuff returned just for the wrong amount on the check with everything correct so I am pretty sure its a big enough deal that they will send all your paperwork back to you. I wouldn't worry about sending your girlfriend DHL since you are going to get the originals back and you can just finish filling them out.

You'd be better off searching this site for answers on how to cancel the petittion, if you can at all. I have read where people advised to stop the check but you should do your own research. I am not advising that. In some cases they can be forgiving of some information if it is apparent of what your intent was but if you made major goofs then they will return it or send you an RFE.

Lets hope they return it to you otherwise you are going to be wondering for four months if it will go through before you get a NOA2.

The best advise I can offer you is to search this site and see what others have recommended in the past to cancel the petittion so you could possibly send a new one. Also, compare your forms to the example forms on this site. Had I done that, I would not have made the minor mistakes myself. We did not get an RFE on our documents.

This is an unusual situation. Do your own research and don't rely on individual comments alone to fix this.

except in pushbrk comments should be accurate. I haven't even read his comments yet but I am sure he will give good advice. I have studied this web site for four months and there are a few that are usually very accurate with information.

Sorry about the mix up. If you search the site for similar postings you'll see that the petition isn't "evidence" that they send a RFE. They cash the check and you wait months to get a denial. If you're ABSOLUTELY sure that you sent the wrong forms and you're not over thinking it you can try withdrawing the petition, wait for confirmation of that, and applying again (write another check). Hopefully you shave off months of waiting for a denial.

I would save your money and wait for an RFE that will probably never come. Read carefully, the part of the I-130 instructions that refers to G325a forms and you'll see that except for the name and signature, no information that's already on the I-130 form needs to be repeated on the g325a. I don't recommend this practice but it's OK. Chances are, they'll figure out which G325a is for the foreigner and which is for the US Citizen.

Thanks. I thought I had seen somewhere that I did not need to fill out the information twice, and I could have sworn that I saw the statement about duplicate information as well. When I pulled the example of the G-325a form a few weeks back, the rows at the top were not filled out and thus I didn't do it....Probably my fault for not being thorough enough but I wanted to fill everything out exactly as the guides had it (funny enough I look today and the G-325a example has the top two rows filled out again).

I guess I will just wait and see what happens. If they do deny it or send an RFE, do they just email me? Call me? Or send a letter?

EDIT - Kind of a sigh of relief - I did find the instructions that say we do not need to duplicate anything except name and signature. We put our signature and names at the bottom of the form, but not the top. Hopefully it will suffice.

Pushbrk is correct. Not to say some particular adjudicator may know less than him and send an RFE. In that case you will send a new G-325a signed by both of you, properly filled out, which you have taken this time to prepare just in case. Life goes on.

Sit back and relax, nothing to do for now.

They will NOT reject the whole thing and you do not need to withdraw the petition.

I can only speak from experience... I forgot ONE CHECKMARK on my I-129F. It went thru USCIS with no problem. But when it was sent to NVC they sent it back to USCIS for review. Now I am stuck in a loop. I would venture to think that, at some point, you will be getting this back.

A G325a is not an I-129F. Any number of check marks on the I-129F can be problematic. Failing to repeat information on a G325a that is already on the petition, is not problematic.

Facts are cheap...knowing how to use them is precious...

All I can add is ask your GF send new G-325 signed. Use regular mail and wait for RFE.

I agree with Push! Better to recieve sound advice, rather than wrong opinions. Please look at Step 2 number 6 on the I-129F Instructions.
