I am American currently living in the UK with my Romanian husband. My question is if anyone knows anything about entry the USA atfer 10 year ban is up. My husband was VD in 2002 for aggravated felons. I want to know if anyone has with through this. If there is any chance for my husband to come back. All his family is there and he grow up there. Also his parents are very old and are having a very hard time making ends meet. They need there son to help them.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I would like to know if it is possible for my husband to get a visa to go back to the USA. He moved to the US with his family in 1992. He was deported in 2002, and was ban for 10 years. The 10 year ban is over. He has 7 criminal charges and his green card was expired at the time. Charges are controlled substance offense possess, felon in possession of weapon-firearm, 2 UUMV, 2 thefts. They were all over 10 years ago. He never got any paper work from when he was deported, all he did was sign a paper saying they were sending him back to Romania and he couldn't come back for 10 years. Could we get I-601 approved? We are currently living in London, but soon my son and I will have to go back to US to take care of family members.

You probably need to talk to a lawyer about it. 7 different criminal charges is a heavy police record.

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

Timeline

Consult with an attorney but highly unlikely he will ever be returning to the US. You state he has a possession of a firearm by a felon which makes me thing the drug charge was pretty serious, or at least he is a convicted felon for some reason. Very, very slim chance he will ever be allowed to return.

Please, please tell me he is not in the UK legally.

You would need to start with a criminal lawyer to get those crimes re opened and dismissed.

Highly unlikely with all those charges but depending on exact charges (ie what controlled substance was he charged with possessing?) I can't say for sure. He should consult with a knowledgeable attorney ASAP. But I really doubt it with 7 felonies.

Drugs and guns are the big ones that USCIS doesn't like to see. It is unlikey he'll be back, even on a toursit visa.
