My fiance is here with me and she wants to stay until we get married, but i know that she has to go back to mexico to go to the interview. I there any way that she can have someone go to it for her or does she have to be there or what?

I think she has a better chance of getting visa approved if she doesn't overstay her touris visa (i assume) and goes to the interview. It might take little bit longer but at least she will be able to enter here legally!!! (once she's legall, she can get a better job instead of working at a grocery store or mopping floors at a restaurant; also you do want to start a family with her so why complicate things more..just tell her to be patient good things comes to those who waiting ...)Best of luck.:)

No, she can't have her interview in the US. The i-129f(once approved) goes to the US embassy in your fiancee's country where she has her interview. Unless she's a resident of a different country and wants her interview there, then no exceptions are made.

Anything that has to do with marriage before entering the US on a K1 is a no-go. With the petition out there, she already showed an interest in immigrating so I am far from sure it would even be possible to get married and file i-130 and i-485 now when already showing immigration intentions. I know too little to say if it'll be scrutinized later on(but my guess it yes regardless of having entered the country legally). You could of course cancel the petition, get married and file a Cr-1 instead, wait in the US until her lawful stay is up and then go back but there will still be some waiting in the home country.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

I have filed nothing yet. There is no petition out and i have sent immigration nothing. I was just wondering if she could stay here while the process is going on.

What do you mean? Of course she has an intention to immigrate she is my fiace.

Getting married with the intention to immigrate on a tourist visa is considered visa fraud. It would be using the visa for another purpose other than the one that's intended. That's a big no-no. I suggest looking into a CR1 or K1 visa.

We have filed nothing yet and have made no actions concerning the immigration, that is why i am curious and good people like you help me out. hhaha thanks. Can she visit me during the cr-1 process? All i have to do is go to the court and get married eh?

Read up on your options, what ever you do do not over stay and incur a ban or delay on future actions just for the short haul.

Yeah, darn, i guess she will have to go back.

I have one a ton of reading and i thought that she could still visit once in a while while waiting for her her package to arrive for the 129f?????? is that true? Can she visit if i get a cr-1 (i was thinking no from what i remember)?
