WTF? Wakass RFE finally arrives

Timeline

Ok, so my RFE came. It lists like 10 things, each with a box next to it. Only one item has the box checked, which is "Birth Certificate: Submit a birth certificate and English translation for the beneficiary."

I thought this was officially not required.

The other things listed (sans description) are:

Foreign Document

Verification of Status

Circumstances of Meeting

Last Meeting

Divorce/Death Decree (this does not apply to us even)

Photographs

Form G-325A (for beneficiary)

Birth Certificate

Other: Consulate you selected does not process fiance visas....

Is this how everyone's RFE looks? The Divorce/Death one and the Other one have unfilled in blanks.

Please tell me it's just the birth certificate. I know I submitted all the other stuff soooo

PS Sorry I have spent the last 5 min searching for answers fruitlessly. I know I could search longer but I just really need some answers.

I'm kinda worried about getting this RFE too. I didn't include Craig's Canadian BC or his passport pages, and I've seen a few people get this RFE even though it's never listed in the items that need to be included in the first petition.

Is that the only thing it's asking for, or is it asking for all that other stuff too?

PS I remember I think Yodrak or someone posting a memo that USCIS was supposed to have sent to all the service centers explaining that this was an RFE not acceptable to collect. NO! I think i was even the beneficiary's G325A. So how can they RFE this?! Ridiculous.

What if the box means it's the only thing they don't want.

If it were a document they wanted, they would specify right?

I believe it'll say something like "You must submit the items checked below:" so only the ones checked you would need to submit.

I've noticed alot of people lately getting RFE's actually requesting items that should have been sent in to begin with. I never heard of a birth certificate being 'optional' - where did you get the idea it was optional?

At any rate, again, sending too much information seems to be alot better than sending to little. You should send back everything they ask for, and more! "Bury them" as Tom recetly said.

I wish I had known to do this in advance, as I fear I'm going to be in the non-IMBRA RFE club too soon.

It just says "request for initial evidence"

and then it lists all these things

PETITIONER BC (or passport) is required. Beneficiary is usually NOT required. I got that idea from all the people who told me that on VJ.

The checklist my lawyer gave me to start collecting my documents said fiancees birth certificate if i lived in certain states( which i did not) But later when i didnt give it to him, he said it was now required with all applications.

Well, Alex is the expert on the K-1 process, but as far as I have read, the birth certificate is not needed on this first part of the process.

Wer'e going to be in Argentina next week, so a Portuguese-to-English translation might be difficult to come by...

I know my birth certificate could have been a copy. Can I send them his as a copy too?

11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of a naturalization certificate. This is used to establish citizenship.

From the I-129f Form:

If you were born in the United States, give USCIS acopy, front and back, of your birth certificate.

Nothing about proof of citizenship (BC or passport) for the foreign fiance, only for the USC.

This is a strange RFE indeed! However, if it turns out that all they want in the beneficiary's BC then thank goodness that's all it is. Perhaps his name was flagged when they did preliminary name checks and they are just trying to rule him out as a possible maniac etc.
