WTF? Wakass RFE finally arrives

Ok, so my RFE came. It lists like 10 things, each with a box next to it. Only one item has the box checked, which is "Birth Certificate: Submit a birth certificate and English translation for the beneficiary."

I thought this was officially not required.

The other things listed (sans description) are:

Foreign Document

Verification of Status

Circumstances of Meeting

Last Meeting

Divorce/Death Decree (this does not apply to us even)

Photographs

Form G-325A (for beneficiary)

Birth Certificate

Other: Consulate you selected does not process fiance visas....

Is this how everyone's RFE looks? The Divorce/Death one and the Other one have unfilled in blanks.

Please tell me it's just the birth certificate. I know I submitted all the other stuff soooo

You got the RFE because you (your Lawyer) submitted a Birth Certificate that's in Portuguese for your Fiancee. He was not supposed to do that! It did not need to be submitted in this phase of the process. The beneficiary needs it when she goes to the Consulate in Rio for the Interview. But because it is in your package, now they want it translated into English.

Action: Get the Birth Certificate translated and resubmit.

Nope, I don't have a lawyer, and I submitted no such thing. I think it's a new requirement that they're not listing on the list of requirements (chopf##ks). I hate when you follow the rules so well that they make up new ones to screw you up.

We used a service and not an attorney to help us with the filing. They had me send a copy of my fiancee's BC. So it is looking like that certainly wouldn't hurt and may even help in some instances.

OK, I don't get it!

However, it can be you that translates the document.

I always attach a cover letter when I respond to an official letter of any kind. Something you learn in the business world. Cuts down on the confusion. It is not required at USCIS, but makes things easier for the Adjudicating Officer.

In that little letter you are supposed to write, the VJ template says " ....is an accurate translation of the document attached, entited "x"

Technically, it's not required, but they always seem to ask for it.

Yep, that's how my RFE looked as well -- basically just a long list of things with a couple of boxes checked.

This is a strange RFE indeed! However, if it turns out that all they want in the beneficiary's BC then thank goodness that's all it is. Perhaps his name was flagged when they did preliminary name checks and they are just trying to rule him out as a possible maniac etc.

I like this explanation. One can never tell why they are asking for it. Did you try to contact USCIS for clarification of what they are asking for. There is a prompt that asks if you are not clear on the RFE to press # whatever. So maybe you should call them and find out what it is they are looking for. Everything or just what is checked.

Yep, that's how my RFE looked as well -- basically just a long list of things with a couple of boxes checked.

Mine just asks for the Birth Certificate, but I think we're going to send in the passport too because it's less than 20 years old, unlike the birth certificate Rey's got at home.

I already printed out and signed the paper, and Rey will be faxing or e-mailing PDFs of the birth certificate (front and back) and his passport tomorrow. Then I can just send 'er in. Yay! Argentina here I come... barring a case of dry socket....

what!?! They send RFE's for the beneficiaries birth certificate?

I followed the directions on the 129F form and on the .gov site. Nowhere was i instructed to send the beneficiaries birth cerificate.

If they wanted it all they had to do was ask!

Ok then, I will accept that it's just the birth certificate they want. What I need to know now is, can Rey take a good scan of it, e-mail it, have me print it out and get it translated here? Wer'e going to be in Argentina next week, so a Portuguese-to-English translation might be difficult to come by...

I know my birth certificate could have been a copy. Can I send them his as a copy too?

Yes, a copy of the original and a copy of the english translation is acceptable
