I agree, fraud was probably the wrong terminology. She duped me. I never followed through with the petition because I didn't get all the info I needed from her. The other guy filed the visa.

My thought was that the USCIS might take an interest in this and deny the visa based on her character. Or do they not concern themselves with such things?

As for the guy in Florida, he may be in on it, I don't know. I am in the process of getting all his information.

Not an immigration issue. Education is expensive and I sincerely doubt the Columbian authorties will go after her on behalf of a duped Gringo. Hopefully you at least got laid. Most men getting scammed don't even get that. Usually it is because of her "high moral character" :lol:

USCIS could not possibly care less. Even if they did she will just say she lost interest in one suitor and chose another, her perogative.

The guy in Florida may be another victim. You don't think she does this only once, do you?

I guess I'll make a call to USCIS, it can't hurt, then drop the matter and as someone suggested, chalk it up to experience. And stay away from Colombia! I'll also warn the guy in FL if he isn't in on it but I have a sneaky suspicion he is. And yes, she is in the US.

I told her I wanted $1000 back immediately as a partial repayment of the money I gave her - I paid for her friggin' trip to the US unknowingly! She seemed scared and said she'd come up with the $$, but then again, she's an oscar deserving actress. Mind you, it's not blackmail, I didn't threaten her with anything if she didn't pay.

I would definitely contact USCIS and show them how she was having you complete paperwork. I'm willing to be that she didn't tell USCIS about her other relationship with you and she's unlikely to get her K1 from this other guy approved once USCIS knows that she was carrying on with another guy while this guy was petitioning her.

If it's possible to find out who this guy is I would also contact him and send HIM a copy of all the information. I know I'd call off the relationship with such proof.

**Edit - I notice you said she's getting married in Jan which means she's probably also here. Once USCIS finds out she gained the K1 via deception she will have her AOS denied and she will be deported with a lifetime ban for misrepresentation. Hopefully though you're able to let this guy know before he marries her to protect him as well.

I don't mean to be an alarmist but does she have your personal information from the paperwork. It's just that identity fraud is a huge issue and don't want to see anything that terribly come of this experience.

I'm torn here. I can certainly appreciate why you'd want to call USCIS and the guy himself if you can figure out who he is. But, what then? She has him under her spell, are you so sure you're not going to get some blowback if you stick your nose into this? Is it worth it to you? You don't even know him, it would be different if this were your friend.

As for visa fraud, she'll just say she changed her mind. Prove she had malicious intent. People fall in love quickly and get married quickly (and their visas get approved). Do you think some overworked USCIS official is going to bother with a weak case like this? Call them about human trafficking, they'll get involved, but some alleged witch (I believe you, but they have a higher bar to meet) taking some guy for a ride isn't big enough fish to fry.

If she had both you and this other guy on the hook during the same period of time to get her K1 to the US then I would report her. If she hasn't had her interview I would also copy the visa unit at the embassy. Obviously she is more interested in the US than the man and I bet she VAWAs before ROC comes into play.

This will not be over quickly. You will not enjoy this.

She did not commit visa fraud, however it can affect her chances of getting the visa if you provide proof that she was scamming you all while making plans to marry him. I think you maybe a bit late if she is here and ready to marry him. The choice to report her is up to you the report will be accepted, it may or may not be taken into account. The reporting should have happened before she was issued a visa.

Sorry to hear about your situation but moving on is probably the best remedy.
