Hello to everyone,i know this is a strange question,but please i need your answers,i married a USC,we filled for a CR1 visa,about 11 month this did not get well with both of us,we got separated,but we have not filled for a divorce yet.The thing now is,i have found a new love online,she is from the USA and will be coming in the summer,please i will like to know if i can change my information,which is my passport,my name and and all necessary document and file for again,please any advice will help..Thank you.

If you wish to change your name and identification as a means to bypass the current information US immigration has on you - no, you cannot do this. Not only would that be considered immigration fraud which is illegal and would result in a permanent ban from you ever being allowed in to the US, it also wouldn't work. There are many security checks all the way through the immigration process. You have to provide legal documents and personal history - and it needs to be consistent. You can change your name if you wish, but you must disclose your previous names. If you fail to do so, that is considered misrepresentation and also results in a lifetime ban from entry to the US.

If your current relationship isn't working, then file for divorce and move on with your life. If you end up with a new relationship with another US citizen and the two of you wish to get married and live in the US together, then you would start the immigration process all over again from the beginning - but with the same name and passport and information. Will they ask questions about this current relationship? Yes - and you need to be prepared to answer them.

If your sole intent on being involved with a US citizen is as a means to get to the US, then trying to hide that fact behind a new identity, will not make it happen. Immigration fraud is immigration fraud and will be uncovered during the security investigations. If your relationship is valid and you only want to be with your American partner - and it doesn't matter in what country that is - then there is no reason for a new identity and you will be able to gather the evidence and history that shows this is a valid relationship.

i would hate to say it but ghana is a location known for dating website/finacial fraud. do not mess with the uscis, they are not stupid and it is not a fair court of law, meaning you are not considered innocent until proven guilty, you are considered guilty until you prove yourself innocent.

On a personal note, not to attack you because i dont know you but true love is a choice and committment to the best for another person no matter what it costs you.(unless you are being abused) I dearly love my fiance but this is alot of work and not for the temporarly infactuated, weak willed or fraudulent.

i would say if you really want to prove you are not a fraud then you need to finalize your divorce properly and quickly. and be prepared to explain to them a really good reason as to why you divorced her, or she divorced you. (we werent getting along doesn't really count) be prepared to share everything openly and honestly. As for your new girlfriend, do not ever ask her to send you money, it's enough that she is coming to see you(which you should be paying for as well cause it is essentually a long date). do not push the idea of marriage early on in the relationship, a sign of fraud. if she really wants to be married she can petition for a k-1 visa with a f-129. you will need lots of proof of relationship including dated pictures of you guys together and with your family, you paying for her flights,printed online chat logs, emails etc.

if you truely love her it will show in your interviews (k-1 and AOS) but it is the interviewers right to deny you for any doubt about your motives even after you have entered the u.s.

marriage with anybody, even a good hearted thoughtful person, is a hard thing, because you are combining 2 different people into one life. I hope this one works out for you.

Your situation seems as though you've made up your mind to marry a U.S Citizen. You're going to have to be ready to explain to the CO when the time comes for your interview - should you make it to that point. Now, why do you want to change your identity? This provokes some considerable doubts as to your intention of marrying a U.S Citizen. Visa journey is here to support legitimate relationships through their immigration journey not a platform for stuff like trying to change identity to beat immigration - it will not work. Any attempt to change your identity without disclosing it on any of the immigration forms will trigger a permanent ban. You're separated from your USC spouse and busily looking for another USC spouse online...unless you explain a little further, I'm having a hard time defining your motive other than trying to come to the U.S.

You are right about it being a strange question. Your current wife filed a CR-1 11 months ago, you aren't even divorced yet and already you are making plans to marry another USC who you're going to meet for the first time in person next summer? You don't even know if this new relationship will work out but you are already making plans to file a new CR-1... and you want to change your name on the documents to be submitted for this purpose... How does it sound to you now that I've put it in perspective for you?

Changing your name for the reasons you've stated is fraudulent. Your face will be the same when you send your pictures. Your fingerprints will be the same. Your parents' names on your birth certificate will also be the same...unless you plan on asking them to change their names as well.

Judging from the OP's wording and from his previous post I don't think he ever made it out of his home country. I tend to like to give people the benefit of the doubt but he's making his intentions pretty obvious. His previous spouse must have caught onto his intentions just in time. Hopefully this new lady will catch on to his game before she becomes too invested.

Or maybe he will proceed with his original suggestion and get caught. Just have to hope for karma or competent adjudicators/IOs.
