The reason for the second RFE is because you need all pages of the passport. Your lawyer wants to get the process expedited? And lemme guess, the lawyer will also charge for "doing this"? And she also said that it's normal for them to only send the biographic page? ... Uhm. Well. I'm sorry you have to go through this :( But, I would maybe think into getting a new lawyer.

To be safe, if the USC could get a copy of their birth certificate, this may be better. They can order this from their state fairly easily. But, there is a wait time. It took me 3 weeks to receive mine. If you don't want to wait that long, just send in copies of all pages for the passport with the RFE. :)

Hi everyone---

blessings! I am new here so thank you all for any support...

We hired a NY immigration lawyer that we had been recommended...

first time she filed March this year ( she said) and we hadnt rev¡ceived NOA1 when month of May came on...

I called her and she checked, no receipt, then she called USCIS, and they had not taken the money for the filing, that she saw at their bank... we had to gather all the documents and file again---

very frsutrating and it was expensive to hire a new lawyer...so we used the same one...

May 19th we got NOa1 and we received RFE End of Sept. 2011 because she had forgotten to cross of that my fiance hadnt been in prison even if they asked us spesifically about this question in march before first filing...so we sent them the reply and after 58 days of waiting they had looked at it and sent a second RFE! How can that be..?

This one said there was not enough evidence to establish that my fiance is a US citizen...the lawyer had attached biographic page of his passport even if it says ALL the pages of his passport?

The lawyer wants to ask for expedite processing if this RFE since they already had submitted the biographic page of his passport. Does anyone know if this is a reason for it? Or will it slow down the process?

So thankful for replies. We have been really frustarted and sad for her mistakes and think we could have done it better ourselves--- now it will cost so much to change lawyer , thoug there are still some parts left of the application process and maybe we will do it all ourselves after this petition hopefully will be approved..

Thanks for any comments and shared experiences. I am about to fire this lawyer...they have slowed down the rpocess for us abot 5 months---

Your lawyer messed up again. You might want to think about ditching this lawyer. When sending in proof of being a USC, you need a copy of the birth certificate or ALL the pages of the passport. Easily satisfy the RFE by sending in both.

No it is not a reason for expedite, on the contrary it is a reason for delay. You cannot ask for an expedite on the petition as it has already been adjudicated and was found to be incomplete. USCIS already did their job, your attorney did not do HER job. TWICE

You should ask for a refund from the attorney. The instructions clearly state you must send copies of ALL pages of the passport, even BLANK pages, if it is being used to establish citizenship.

Make sure to get the NOA's from your lawyer, especially NOA2. If it's not needed at your interview at the embassy, it is definitely needed after coming to the US and adjusting your status. Right now you're checking into the things anyways so a little suggestion is to bookmark Visa Journey and read the guides/flowchart. It'll come in handy later on, knowing for yourself exactly what is needed. They aren't hard to read. After all, a bunch of us are the foreign spouse/fiance on here :) If your comfortable with a lawyer doing the paperwork then stick with one, esp if your case isn't straight forward.

A lawyer can't guarantee an approval, they just gather the documents from you, and drain your account at the same time. Good multi taskers, they are for sure!

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

I heard so many bad stories about sloppy work of lawyers that I did everything myself. No problems.

It does take some time and attention to detail but it is certainly cheaper :)

However, if there are any big problems then I would certainly recommend a good Immigration lawyer with experience.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

OMG! I hope your lawyer didn't just respond a request for expedite on your RFE... :) it's dumb to do and it will get denied, they ask for additional evidence, just send a birth certificate and colored photocopies of your fiance's passport.. To make sure everything is clear and readable.

Good Luck! And I hate lawyers.. I hired one for my divorce.. They just made mistakes to make more money.. Grrrrrrrrr.. :bonk:

Dump the lawyer now. You don't want this kind of buffoon to be doing your paperwork at the embassy level...assuming you want to get to married one of these days...and yes, you need ALL of the passport pages, not just the bio page. Take a look at the guides here at VJ. They'll tell you everything.

I recieved an Rfe at the same stage as you, my lawyer had it fixed within 30 days. It took my k1 , 10 months.

yes, its so strange====she says she has worked with this for 30 years..

that is a jokeª

i know, it says clearly in the instructions that we need to include all the pages of the passprt and they suggest a birth certificate as well.

so we will send this....the lwyer thinks it doesnt matter to ask for an exopedite because if they dont acept it she says they wil process according to normal timelines...

but i dont know if i trust her anymore after what has happened now..

the mistakes..i am lil worried she just makes things more complicated

My lawyer did the same thing to me . She said she filed in July 2011 and got NOAs in Sep 2011! What a waste of money and time. Sad but true! Goodluck on your journey! :)

i remember that she had to have days to do research to answer my questions early in the process...

yes its annoying because we had already paid the full fees.......to her and theya re not interested in giving it back.

I think the reason why some petitioner hires a lawyer is to prevent RFEs... :( . There are a lot of people here who didnt hire a lawyer and didnt get a RFE, I really think these lawyers intentionally leave documents behind and long for RFE's . More Rfe's More money.. grrrrr.. I hate Lawyers.. :(:devil:

Why? Is your case a difficult or extra complicated one?

Thousands of people just do it on their own, it literally takes a few hours to read FAQs here on forum and on USCIS site.

I'm of course not trying to talk you out of throwing another thousand dollars away ;) But you DON'T need a lawyer, especially at this stage when everything is already filed. (Unless, again, your case is difficult, needs professional help, etc.)
