I am about to mail my application by the end of the week and I had a question about my i 485. I am married to a US citizen and came here through an F1 visa and still in status. I am a little confused on what to choose in Part 2 in regards to my eligibility should I pick other and say married to USC? Please helpppppppppppppppp

Nov 25,2011(Day 0) - Mailed I 130,I 485, I 765 and I 864
Nov 28,2011(Day 1) - Tracked on USPS and saw that it had been delivered
Dec 1, 2011(Day 4) - Received emails/texts that application was received on Nov 29th and an I 797 is on its way
Dec 1, 2011(Day 4) - Checks cashed
Dec 5, 2011(Day 8) - NOA1 Hard Copies received with Dec 1st as Notice Date
Dec 9, 2011(Day 12) - Biometrics Letter received for 12/22/201
Dec 16, 2011(Day 19) - Biometrics Walk in completed in less than 30 minutes
Jan 24, 2011(Day 58) - Received text/email about card EAD card production

A: An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

That immigrant petition is the I-130 that you are also filing.

I chose A but I went to a lawyer for advice and he told me I was to choose other since there is no certainty that my i 130 will be approved.

Also in the part 3 do I include his name when asked about spouse and children?

You might want to consider finding a different lawyer.. that paragraph clearly states:

A: An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

IF approved. You are filing the I-130, which is a relative visa petition, with your I-485 application. The I-130 will give you an immediately available visa number, IF APPROVED. It is the correct option, and your lawyer should know this..

Your lawyer is an idiot. If your I-130 isn't approved you won't get a GC. It's that simple. There is not "other" option for you. The I-485 will only be looked at once the I-130 is approved so you're not lying by saying your filing i-485 based on an approved I-130.

I would NOT use that lawyer for any immigration help (or any other kind, for that matter). He is clearly wrong. It is to be filed as everyone else has stated, as A. That is what the rest of us AOSing as spouses of US citizens have done...and nary a problem :thumbs:

I am not going to use him again. I only went to him for consultation but obviously he doesn't know what he is talking about.

I have another question. He said it is an issue that my husband is buying a house that we will be moving into and my name is not

on the house. Is that going to affect us when the interview time comes around? The reason why my name is not in the proceedings is

because I have no credit or source of income.

Any advice will be greatly appreciated.

Of course it would look good if both of you would be on the deed but - even an IO will understand that you have no credit. If you are not paying your half of the house at the moment it is understandable that you are not on the paperwork. If I were the one paying for a house I wouldn't put my husband on the paperwork either, and he wouldn't want to be.

If you are worried about papers in both of your names, join a club, a gym, get utilities in both of your names, get cable/satellite in both of your names and have him put you on his bank account.

It's fine as long as you guys live together, in the I 130 instruction USCIS states that it only needs evidence of co-habitat.

No. Your name not being on it isn't an issue as long as you have other evidence. My name isn't on the deed of our house because I had no credit history and it would have made the interest rate REALLY high.
