Hey guys, I have waiting now for over 5 month for my NOA2.

I am wondering if this may be in part to some information I included in my I-129F petition. I honestly told USCIS that Julia and I were planning a religious ceremony in Germany, though we were well aware this would not be a legally binding ceremony. In fact, I indicated that this ceremony was simply before God and loved ones, in order to pay Julia's family the honor of witnessing her marriage. We do plan, however, to legally marry in America, hence the reason I petitioned for the K1 visa in the first place. The religious ceremony is planned for late-September in Germany, so I am praying that we will by then have her Visa in hand so as to return to the States for our legal wedding thereafter.

Do you think this issue has or will raise red flags with USCIS?

I would refrain from any ceremony.. if USCIS comes to know any marriage has taken place by any means.. it will cancel K-1 visa...

Depending on the Country, A religious ceremony can be legally binding. That not withsatnding, it probably has little to do with your application so far. You are just barely over 5 months and the service centers can fluctuate wildly from 3 to more than 6 months for NOA2. You are at the point where you need to call the service center with your case and make some inquiries. Chances are they will tell you to wait until after 6 months, but at least you get the ball rolling.

Even if you get NOA2 now, planning for a late september return to the US is pushing things. From your timeline you started at the beginning of February so you are shooting for the low end by planning on just over 8 months to be completed. Double check that the religious ceremony won't cause you any headaches but definately don't make plans or buy any tickets until you have the visa in hand.

As long as it would not be seen as a legal marriage there. Have an officiant that is not recognized/authorized to perform a legally binding wedding.

You can always do the ceremony for the family after the legal marriage here in the US. Then there are no worries.

You can always do the ceremony for the family after the legal marriage here in the US. Then there are no worries.

Thanks for your reply. How do I find the phone number for the Vermont Service Center? Nowhere I've looked has provided the phone number, only the toll-free USCIS line.

Ah...that was someone else who suggested I do so. I did call the toll-free line this week, but to no avail. I was just hoping there was some way to directly contact VSC.

I dunno, just willing to try anything to speed up the process at this point.

Is the religious ceremony the general way ppl get married in that area?

Once you complete your religious ceremony and for whtever reason if the relation is not working, do you need to file for divorce if you want to go separate ways?

Well, for one, divorce is not in our vocabulary. That's not an option, nor will it ever be.

I do believe this is the general way people get married in Germany, but regardless, we recognize that we are not going to be "officially" married at this point with the authorities that be--nor do we want to be so. We want to be married legally in America, where we can then enjoy our lives together.

It's all crazy at this point.

But, you have to be careful because, even if you don't consider yourself "officially" married, Germany might. And if Germany does, the U.S. does... and the K-1 visa goes down the drain.

What I was saying is - if that is the ceremony ppl perform when get married then you would be considered married.

When I said divorce I m not talking about u 2, I am saying assume there is couple who is not going to move to US is just going to live in the part of world where you want to do the ceremony, they perform this ceremony and then after 5 yrs they choose to split do they have to file for divorce?

If you answer yes then your ceremony would be considered as a marriage, then you should not file for K1 but CR1.

We have traditionally religious ceremony in temple and applied for k1 visa which was denied by saying that we doesn't provide sufficient evidence to prove that we will be going to marry in US in 90 days .

Now we are very stressed we are thinking to do legally marriage in india then apply for cr1 .

Is it right way to do so?

Yes, you most likely will be denied a K-1 visa since you'll be considered married. Bad idea.
