I just wanted to know if we HAVE to file the I-485 together with the I-765 and I-131. Could we apply those separately or individually? If so, how much will I have to include with the I-485. I just wanted to know the fee breakdown for all three. I understand the I-485 fee is $1070 which includes the fee for the other two forms plus the biometrics fee. I just wanted to if i could file the I-765 before the I-485 and I-131 so that my husband could start working. Your help will be greatly appreciated. THANKS!!

If you file for work permit prior to the filing of the I-485 it will expire on the expiration of the I-94 which means it will probably be expired by the time you get it. You cannot file for advance parole without the AOS having been filed.

Yep, as the others have said, it will cost you $380 to file the I-765 before filing the I-485. It is a waste of money because the EAD you would receive would expire when your I-94 does. It is best to file them with your I-485 so they are free, and the EAD you will receive will be good for a year. So, just file all 3 together at the same time, and pay only the one fee of $1070. That one is hefty enough without paying extra for a fairly useless EAD beforehand.

The AOS costs $1070. The fee for the I-765 and I-131 are WAIVED when filed together with, or while AOS is pending. The fees are not "included" in the cost of filing AOS as that implies that not sending them reduces the AOS price.. it does not. If you don't file the EAD and AP docs then the fee is still $1070. If you DO the cost is still $1070.

No to the I-765 being filed before AOS. Well you can but you would pay for it ($340) and it would take around 2 months to arrive and is valid until the I-94 expires so it's a complete was of money.

thank u so much guys for the help. i definitely will file the I-485 together with the I-765 and I-131. i didn't know that the EAD expires the same date as the I-94 if filed alone. Good to know. I would've wasted over $300 for and EAD that would be pretty much useless!! WHEW!!

When people say you file them together, does that mean you physically submit them together, in the same package?

Yes but you don't have to.

You could also file the EAD and AP after you've sent AOS (but before AOS is approved) and you would need to include a copy of your AOS NOA1 in order to have the fee waived.
