i am US citizen. I am married to indian citizen as it was a arranged hindu marriage and I applied for his immigration I-130 petition (spouse visa) in the month of april 2010.we submittied all the required documents at NVC. Medical examination was cleared as it was held in month of january 2011 his interview was scheduled at 17th february 2011 and consular asked him to submit some missing documents(such documents were affidavit from both of us about how,where we meet and why we decide to marry each other, photographs of us before during/after our marriage, name of 5 years voter's list, explanation from our parents about our married life, Emails, phone bills, greeting cards/letters,guest list of invited guests our marriage,copy of my passport and visit details of india after marriage as I traveled twice after marriage)

at vfs office jalandhar(punjab)india.Then he submitted whole required documents at vfs office on 9th march.

Embassy returned his passport on 18th march by courier with a letter indicating that his case undergoes Administrative Processing and on 18th march embassy called him and told him to come at 24th march 2011.

but then on 23th march embassy called him and told him that his interview has been cancelled.

I am 7 months pregnant and due date of delivery is 30th July. so here as i am facing extreme hardship in my daily life. Today I got email from the VFS helpline as it was indicating "As per the U.S Embassy your husband was interviewed for an immigrant visa on February 17, 2011. The visa interview revealed new information, which indicated the visa petition was not approvable.Therefore, the petition was returned to the approving office of the U.S. Citizenship and Immigration Services for reconsideration April 26, 2011. Any further inquiries regarding this case may be addressed to approving USCIS office directly as this case is no longer at our office"

so the thing before all this ###### happened is that my husband was married before with a girl in the year 2008 without knowledge of both of our family members except me through an travel agent who deals with student visas to australia for just immigration purposes as the girl was going with him on dependent visa and she was going to bear all expenses,fees etc. but meanwhile the idea of going australia with him was end up due to the confusions and money problems but that girl didn't give divorce and my husband also didn't give a damn about that as he was unknown to the evil plans of that girl.AS in the month of january 2010 our family met with each other and decided to finalise engagement ceremony.but the plans were change due to busy schedules of every relative our families solemenised marriage as well as engagement ceremony.

as everything was going so well untill we got a call from that girl stating that she is going to make our life miserable as she started black mailing on behalf of her marriage certificate and day by day her demands were becoming huge as she asked us to pay 50 lakh ruppees for keeping her mouth shut( which we weren't able to pay in our whole life) or otherwise will face problems in my husband's immigration petetion. so now the visa has been refused of my husband as she complained emmbbasy that this man is married again with a usa citizen without taking divorce from me.

our lives on stakes so pls help me out do i appeal,refile,or what is any other options there

what should i do now or what is the best way to bring my husband here

Your marriage is null and void as your husband wasn't free to marry. He should've come clean before and got a divorce. Nothing you can do about it until he gets a divorce decree. Then you need to get married again and start a new I-130 petition.

Since you knew he was still married, why did you continue on to marry him, you yourself have committed immigration FRAUD by submitting the petition for a visa approval.

There are several points that stick out from your post.

1) You entered an arranged marriage.

2) You married a man, knowing that he was still married. In the US, we call that bigamy. It's a felony.

3) Your not-husband has a documented history of entering a marriage for immigration purposes only.

4) Your husband committed material misrepresentation and, assuming bigamy is illegal in India as well, a felony.

The way I see it, your only option would be to move to India. I'm sorry if this sounds harsh, but I do not see any Consular Officer approving a visa petition for your not-husband under such circumstances.

Mumbai is beautiful, by the way.

thanx to you all guys for ur replies but i want to add 1 more thing that ma husband has filed a declaration case against her for blackmailing, cheating, and divorce also so it is the only hope right now as it will be in our favour coz it is not challanged by the other party at all.

As milimelo was suggesting is it right and legal to marry the same person again and if yes what about our previous application and denial will effect it

As i m going to be mother within august 2011 does it help us in anyway to bring my husband here or on behalf of our newborn, can i file any waiver or sumthing like that to bring him here

And please tell me something about the process of appeal/motion and what would be the total time taken for this process?

You must accept responsibility for your role in this, you filed a FRAUD application with the US government for a visa petition for your non-valid marriage. you knew that the not-husband was not free to marry. The US immigration is not going to allow your non-husband to migrate, but they may take some kind of action against you.

There is no visa that would be offered to the father of your child to come to the US to visit after he has just committed possible visa FRAUD. Please seek the advise of a good immigration lawyer for further dealings with US immigration.

I'm not sure you can easily find your way out of this. You entered into a fruadulant petition, your 'husband' has a pattern of marrying for immigration. These are tough things to get over

I'm sorry, but your husband will not be in the US anytime soon, you will either have to travel to India or have your child wihtout him in the US - you cannot petition for him in the near future, not unless he is divorced and you re-marry..then you can expect this mess to come back again

There are two paths your life can take. If you are very very lucky they will simply say you are not legally married and therefor not eligible to file as a couple deny your petition and file it away. Then he has to get divorced you both get married again and then you refile. This will probably take a couple of years and there is little chance of him getting a visitors visa in the mean time. This is the fairy tale good path.

The nasty path is that they will say you help him file a fraudulant petition and misrespresented facts to the US government. He will be banned for life, with no possibility of a waiver. If you are not a US born citizen they could decided what you have done is bad enough to revoke your citizenship and ban you also.

What really happens will most likely be in the middle somewhere. I would be suprised if he is allowed into the US for many years and if he is it will probably cost as much as a small house in legal fees. You may have to consider moving overseas if him being in your childs like is important.

This will not be over quickly. You will not enjoy this.

Your right I guess that would be bad advice you never want to get caught lying to the embassy, I was just thinking they would have to prove she had knowledge before they married not after to keep her out of legal troubles you know the 5th Amendment right to prohibit self-incrimination.

Never mind that she has already admitted it in writing, on the Internet for the whole wide world to read, along with the people from USCIS. Now you want her to add to her troubles. :bonk::bonk::bonk: lying is never a good thing.

Actualy the fact is this i came to know about the prior marriage after 2 months of my marriage(after 10 days of filing k3 petetion) and i want to clear it again that i m not a dumb girl if i know it before my marriage i will never marry him and 2nd thing is this he love me more than everythng i know that very clear& the prior marriage was just his big mistake as well as he met that girl only 5 or 6 times ,both of us came to know whole problem when she called my husband and asked for money to keep her mouth shut and also she complained to police and filed false complaint of dowry and jewllery but her lies were caught by police in enquiry from the jewelry shop that he prepared fake bills and there is no one whom they issued that bill of amount 6 lac ...as the bill was only of 6000 rs and she changed the amount by her self to 6 lac,then police department closed her false case and ma husband cum clear on that issue

And other thing bad luck never gives u a warning that i am coming ,be ready....as it was just our big time bad luck
