Hello!

Can someone clarify for me?.... :blush:

My significant other came here on a K1 visa and we are now trying to complete AOS.

Do I send the I-765 applications with the I-485?

Or do I need to wait for the NOA from the I-485 and then submit the I-765?

ah someone else doing aos too! i was wondering if its even worth it to do the ead because i thought it expires in 90 days anyways, and thats usually how long it takes to get it, or am i misinformed?

The EAD stamp (which they no longer give) used to expire when the K-1's I-94 expired (90 days.) I'm not 100% certain but I think the EAD that you'd get as part of the AOS process is good for 1 year. And, it's free when filed as part of AOS.

if you apply at the same time, you might get EAD approved before Green Card. If you get EAD first, you can start working while you wait for Green Card to be approved.

  • 04-11-11 Day 32 = AOS Text/eMail Confirmation
  • 04-14-11 Day 35 = NOA (EAD & AOS)
  • 04-15-11 Day 36 = Bio-Metrics NOA
  • 05-10-11 Day 61 = Bio-Metrics Appointment
  • 05-17-11 Day 68 = Submitted Request to Correct Name on 485 & 765
  • 05-23-11 Day 74 = Status online shows I-765 (EAD) Approved
  • 06-02-11 Day 84 = EAD arrived in the mail
  • 06-02-11 Day 84 = Went to SSA office (name wrong on Master Immigration List)
  • 06-12-11 Day 95 = InfoPass to correct name
  • 06-12-11 Day 95 = SSA office again Pending name update
  • 06-??-11 Day ?? = Received Social Security Card
  • 08-03-11 Day 146 = AOS Interview

You're misinformed. When applying for the EAD with AOS you would enter "C9" as the eligibility category. The card will be valid for one year.

It is possible to get an EAD prior to filing AOS but you would pay for it, it would only be valid till the I-94 expires and you would enter category A6.
