My Fiance failed her interview May 18, 2010 in Phnom Penh Cambodia. The interviewing officer found evidence to lead him to believe the relationship is a sham etc.etc.etc. So after futal attempts I gave up trying to find the real reason of the failed interview. I forwarded a mountian of evidence showing proof of our relationship to the USCIS to be approved. But it appears it just a cursor of events to the Embassy in Phnom Penh. I've been told to try the Fiance Petetion again, this time be available at the interview date over there.

So any experience with 2nd, 3rd attempts?

Success rates with refilings?

My last visit was January 2010 to Cambodia, so I know I have until Januray 2012 to file. Just dont want to raise any red flags or shoot myself in the foot by refiling.

Your suggestions are appreciated.

I did all the filing myself and found it very easy and simple, here in the states. The problem is over there at the Embassy.

I just heard the same story from my Cambodian friend. His cousin's fiance failed twice at the interview. The first time they tried doing it all by themselves.. The second time, they hired a lawyer. But even he couldn't help. The guy at the embassy just didn't believe - period. I wonder what's up with the Cambodian embassy? Why is there such a high rate of denials?

I suggested they get married and try filing for the spousal visa..

I believe others would agree when I suggest you find out the precise wording of the denial on the sheet of paper given to your fiancée. This allows you to prepare to overcome the claim against you. You mentioned forwarding "a mountain of evidence," but specifically what did you send? Evidence is embassy specific, but for example the Bangkok embassy does not accept calling cards as proof of ongoing relationship. More information is required in order to assist you.

You must find out why it was denied, EXACTLY why it was. If you file again or file for a spousal visa you may hit the same brick wall and be denied again for the same reason.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

We filed a K1 twice through Lagos Nigeria. The first failure was a mess but the second time we made it past Nigeria's famous witch of a CO. If you provided too much evidence and your fiance wasn't well versed in it , that can sometime lead to issues. Have your fiance reconstruct as closely as possibly exactly what was asked and exactly what she answered. Many times a CO will use several slightly wrong answers to jump on the sham relationship band wagon.

This will not be over quickly. You will not enjoy this.

Some people who get denied a fiance(e) visa at the interview choose to then marry and file the I-130 instead. Not that doing this would fix whatever problems were identified during the interview, but at least the beneficiary would enter the USA as a resident and would be able to work right away, if desired. Still, you would need to make sure to address and fix whatever issues were the reason(s) for the first denial. Why did the CO believe it was a sham relationship? Did she answer questions wrongly? Did she not provide evidence of your relationship? You really need to know how and why the consul perceived your relationship to be fake in order to hope to be successful.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Agree that you need to re-construct the interview and see what the issues may be, and that getting married may be a good idea.

One thing I noticed, you mentioned that you last visited in Jan 2010 and thus have until Jan 2012 to file. While this is true, the more visits, the better- it goes towards bonafide proof, but also will help you get more knowledge of eachother.

Why the wait, the 2 year rule DOES NOT mean that you have to wait until 2 years elapse since

your last visit ( if you waited 2 years then the long wait may have contributed to your problem) It means that you must file at some time before that 2 year limit has passed. You could technically file while you are still together.

This will not be over quickly. You will not enjoy this.

You said they think your relationship is a sham. I guess you have to prove it's not, the next time around. There are people who tried same k-1 route a second time and got it, while there are some who hit the same wall. If your mountain of evidence did not convince them, you should do something else other than just throwing evidence again and again. I would advise you get married and document everything. If the CO did not believe there was a legit relationship, a marriage with evidence might sound more convincing. That said, I would not try the same thing and expect a different result. Go the I-130 route.

Very sorry to hear that. Did you find out what evidence the IO claimed they found that led him to believe your relationship is not genuine?

Also, how did your fiancee counter his arguments?

My personal opinion is that if your fiancee is that important to you and you want to make this work, try, try, try again. I know the process is tedious however, as you continue to stay in this relationship, and again file another petition, that in of itself is additional evidence that could work in your favor to show them that this relationship is not a sham. Additionally, I am not sure what type of information you previously submitted, but keeping records of calling card receipts, skype chats, msn chats, e-mails to each other, receipts for letters sent to each other can all be additional evidence that you can continue to compile to help make your case a little stronger.

We dont have chat logs from on-line communication but we do have receipts from Western Union showing monthly financial assistance. Does anyone have advice or recent experiences to share regarding interviews in Phnom Penh? Should I fly from the States to be there or should my fiance go alone?

I would guess that being there is one of the best things you can do. But I don't know much about the Phnom Penh embassy.

I have a friend who got married there, stayed a year, and then he got his wife to the USA with a spousal visa. They had no problems.
