hello vjer's i got a question for a friend,my friend came here few months ago and got married by her then fiance,shes planning to bring her son here in the u.s but she hasn't apply for aos yet.is it possible for her to file for her son paperwork even if she hasnt have applied for her aos??any inputs appreciated.

Depends, how old is the boy? What visa did his mother use to enter the US?

Yes. Her son can get a K2 visa up to a year after she got her K1 visa. The process is called "follow to join". She'll have to submit pretty much the same visa application forms she had to submit at the US Embassy, pay the same fees, and her son will need to have a medical exam. Once her son arrives in the US then she'll have to submit an adjustment of status application for her son to get a green card.

If she waits more than a year then her US citizen husband can submit an I-130 petition for the child. Once the petition is approved, then the child can apply for an IR2 visa at the US Embassy. Different forms and fees, but a medical is still required. Once son arrives in the US then he'll get a green card automatically.

05/01/2013 - Removal of Conditions - APPROVED!

thank you for the info...what are those specific forms needed to be filled out?
